Hi all,
I have now been the victum of EBay con.
You and I can make alot of money by doing the same thing:).
I paid nearly $18:00 for a secound hand item.
I was sent some other junk worth nothing (I checked on google and it has no value as doesn't work without other parts)
I put I claim into EBAY and they said because i received an item that was sent by mistake by a child, I will not get a refund.
This opens the door for everyone to sell non existant products to people and just send anything to hand (pen, pencil whatever) and say a child sent it and you to can keep the money.
I went to the police and because it was under $100.00 they can do nothing. (But even he said EBAY shouldn't allow such a scam, This will make him have secound thoughts about buying off EBAY)
So as they say, Good EBAYing everyone.

Did you open a dispute for item not arrived or item not described? It should have been the latter because if you chose INR and the seller can prove they posted it (i.e tracking), then you would lose the case. Open a dispute through PayPal for item not as described and see how you go. If that doesn't work, come back here for extra advice on where to go next.

Ebay seem to think that they are the Judge and Jury and Australian law doesn't mean a thing to them.
It's ebays rules and nothing else matters even if they are totally wrong.
As a seller I was scammed by buyers and you're the buyer and you were scammed by a seller.
Ebay lets it go both ways as long as ebay wins out in the end,it's all about ebay and how much money ebay can make.
We should be able to take ebay to court and fight for our rights with a fair trial and not blind folded by the toss of a coin so to speak.
Too much scamming going on and in the end the winners are the scammers,well done ebay

I'd be interested to know how eBay could determine that (1) sent by mistake (2) by a child.....?????
I, for one, would not be accepting that as a reasonable/rational explanation for refusing a refund.
And when you consider how many other buyers get a full refund, get to keep the item, in spite of all evidence............and that's from honest sellers.
What a load of crock!!! eBay must have used a different dartboard in your case.

I was thinking the same thing kazam.
It all sounds very shonky.....I would not accept it either.
If the OP made an ebay claim maybe it is time to try a paypal claim for item not as described. If he activates the paypal return postage option it should not cost anything to return the item to the seller.

would it be possible to get a few more details,
what was it paid for and what was it you received?
what kind of case did you open with ebay?
without these 2 pieces of information how can anyone make a comment on how you were treated.

How old is the child? Most young children probably wouldn't know how to properly wrap and address the item, nor could they get to the post office to post it. Older children like teens could, but it all sounds a bit shonky to me.

Totally agree, kazam.
The way it reads, it sounds as if the seller must have given that explanation to ebay when a claim was made against them, and the ebay rep has accepted it.
But to me it begs the question-surely a young child is not supposed to open or be using an ebay account? If they were using a parent's account, then you would think ebay might just cancel the whole transaction asa mistake, but in that case, they would need to refund the buyer. The fact the 'child' might lose out on postage costs or whatever would be a valuable lesson to the 'child' to do things properly in future.
If everything the buyer outlined is accurate, I would not accept the ebay ruling. I'd be ringing up again & putting in a not as described claim, pronto.
