I purchased a camera from an Australian Camera Supplier in Western Australia.  I was referred to him via Whirlpool forums and he had the best price I could find.  The supplier covers the camera under their warranty for 12 months. 

I had to sell the camera and some storage disks as I had some expensive dental work to pay for unfortunately. 

 

I started the bid from $1 and it ended up selling for $1000. 

 

Now the buyer is complaining that I misled him saying that the camera I purchased was from a grey importer and not an australian supplier.   The company I purchased the camera from is a registered company in Australia.  He sells photographic equipment to professionals and on his website is very transparent about his warranties etc etc. . 

 

The buyer is nasty and complaining that the warranty isn't good enough.  I had in my listing that it was from an Australian Supplier and was under 12 months warranty.  Nothing I have said has been a lie or misleading.  There were lots of people bidding for the camera. 

 

Now he is saying he is going to lodge a complaint with paypal.  I'm very upset about this and I don't know what to do.  I've done nothing wrong and I wish I had the camera back and hadn't had to sell it becasue it was a lovely camera. .

 

Anyway, any feedback form anyone would be really appreciated.

Question - if you do go the route of partial refund, is it against rules to send a mutual cancelation request to get your FVFs back (meaning it is actually a $50 partial refund based on my calculations).

Don't laugh or think I am silly - it is a legitimate question

How does this sound to put in my pay pal claim

The camera which I listed on ebay is “exactly” as I described and the photos of the camera and other items are what I sent to the buyer. The buyer has not once told me that he thinks it is a different model however! The buyer however has disputed that the camera and storage discs were purchased from an Australian Camera Supplier saying that it was not bought from an Australian Supplier. I purchased the camera and storage discs and camera bag on 12 August 2013 from My Camera Focus which is an Australian Business located in Western Australia www.mycamerafocus.com.au
The only question prior to bidding on the camera was asking if the receipt would be included in the sale of the camera goods. I stated in the listing that the camera was still under warranty. The warranty is covered by the supplier for the period of 12 months.

I have the receipt and invoice from the supplier. The warranty is stated on the suppliers website which paypal can go to . I have photos of the camera as per the pictures I put on ebay. I have emails from me to the supplier and back. I even have the paypal receipt for the camera when I originally bought it.

  • 23/11/2013 20:39 AEDT - Buyer: this was a camera purchased used stating it was originally purchased from an Australian camera supplier.The camera is a grey market import shipped directly from overseas and not an Australian model.The original invoice has no gst attached to it making the point of sale an overseas transaction.This item is not covered by a manufacturers warranty rather a third party repairer.The seller tells me to stop complaining as it is a great camera,and the last correspondence stated she would let paypal decide the outcome.I feel her advertisement wording is deceptive and untrue and no indication that this is an overseas model.Had this been disclosed I would not have even bid.

I purchased the camera from an Australian Supplier.  How was I misleading??

Great start :))

In the text i would be crystal clear about the supporting evidence you are attaching. For example, as stated in the listing the camera is under warranty a copy of which can be found on their website (and put in the exact full website address if the warranty page).

I would definitely reference the actual paypal transaction number of the original purchase - thats almost the best proof of all.

Also add in the buyer has sought a partial refund for xxx and that the reasons they sought a refund have changed throughout your communication with them.

What does he mean by "different model" and not an Australian model?

 

If he is trying to say that it was made in an Asian country then it it probably right....most cameras are these days.

If he is saying it is a fake then he will have to get proof of that from an authorised 3rd party before paypal will even think about refunding.

Call PayPal and explain everything to them. That way you might get a reasonable person who will actually understand the situation rather than someone who just scans messages and forces buyer to send item back to you. PayPal USA is still open so give it a shot?

Read up on grey imports and they are not fake goods nor illegal - but controversial for sure. I didn't get too far as my eyes glazed over. Would have thought there would be some regulars familiar with the term and what it means .

As you have not stated in your description that the item came with manufacturers warranty - and the camera comes from an Australian suppliers and has a warranty - the type of which is not explicit nor misleading as far as i can see as it does have a warranty and with terms that state they match the conditions of the warranty of the manufacturer - then can't see his claim can have legs - given all the available info you have OP.
