Its a buyers wonderland on Ebay. They can trash me but I cannot respond in kind. Is this the real world of retail?

By all means laugh at me, but I warmly encourage you to do it silently to avoid embarrassing yourself further..
There are two different contracts,
1) The one that you enter into with eBay when you join.
2) The one that a buyer and a seller enters into when they enter into a transaction with each other.
The reason that you pay eBay a FVF is because this is the fee that you agreed to pay for using the service they provide - the platform for you to meet and enter into negotiations with trading partners.
eBay do not provide a product. They provide a service, a service that provides a platform for trading partners to meet and engage with each other. They make no guarantees as to the validity of any outcomes and have absolutely no jurisdiction to become involved in a contract formed between a seller and a buyer as the law excludes an outside party from doing so.
