I think its about enforcement and how they do it. I doubt that eBay employees have enough man power to police every single listing on the site.
Nor there would be effective automated way to detect every single illegal items on eBay.
You really can't just compare to another country and expect our standards to lower because of it, to each his own I would say.
But anyways, why are drugs illegal and yet I hear stories all the times about drugs? Why are there killings everyday when its bad? Regardless of the law or rules or whatever, someones always out there going to break them. Maybe we are lucky we are in a country that enforces it better than others (waiting for impeding flame to return).
