c/card chargeback, proof of fraud - paypal don't care.

first ever credit card chargeback. sent messages via ebay to buyer and tried ringing with no responce. tried her email from paypal.

my message was simple - have you phoned the police yet? - that got a responce from her.

have now got 31 emails from her, wish i had the time to write them all out as its classic, she goes from denying everything to acknowledging her account was hacked by her friend. friend rings her in between our messages and wants to send me the money. i am telling her in most of my return emails to call the fraud squad and to cancel the case via the bank or paypal.

shes driving to the bank, then shes at home but bank wont cancel / she does not have a paypal account. then the postie delivers the dvd this morning between the emails.

she admits that only my case was a mistake but not all the others.

3rd call to paypal and put through to some kind of safety person, even with this proof they are not really interested and keep telling me to work with the buyer. i became so frusted that i did something i dont usually do and swore at him.

buyer is new to ebay [just before Christmas] has [24] all from sellers who leave instant feedback / wonder how many more like me who dont leave feedback straightaway.

all the purchaces seem to be for cheaper items [mine was my dearest used dvd at $14] so not sent with tracking. 

if you woke up on new years day with a credit card charge back you aren't alone.

very disappointed with paypal would have thought with what she wrote that they would jump all over it. guess non Australian companies dont have to report fraud?

Bottom line is if you choose to post by a method that does not qualify for seller protection you have to refund and Paypal have very little leeway to do anything else.

What you can do is tell the recipient of the item that unless they pay $XX dollars into your bank account within 48 hours (give them the details) you will be reporting them to the police for obtaining goods by deception.

You said it was sent without tracking but mentioned item was delivered this morning - how do you know this?

she told me via email this morning in between all the messages that it was delivered by the postie there and then. which is an obvious lie since she also said her friend already had it in an earlier email.

You need to also know that PayPal will slug you $15 if you win or lose the dispute. I am not sure if PayPal will consider eBay messages to confirm delivery - they usually don't. I had 1 credit card chargeback this year so I know it sucks.
