someone selling one of my custom made dolls as their own and as NEW

i have a previous buyer selling one of my reborns that was purchased from me back in march this year. she has listed it as a NEW item and date of birth as december 2012 and though she has not claimed to have made it she has presented it in such a way on a template so that it appears she is the artist. i have sent her an email telling her that her listing is fraudulent and that i would report her if she did not remove it or adjust her listing. i intend to do this tomorrow if i do not see any changes or response from her but wanted to know ...does ebay block them if they see that they have posted a dishonest listing. am thinking of naming and shaming her by posting her item number and ebay id here as well as a warning to others?? she paid $350 for her, has had her for 9 months. listed her as new and is asking for $525 on buy it now +$35 postage for a used item. maybe i should be flattered??? lol anyone else had this happen?

Unless her listing is IDENTICAL ebay won't do anything.You are also not allowed to name & shame on these boards.

As for her selling at a higher price,well once it was sold,sorry to say but she can do what she likes with it.

If anyone buys it,its their problem if they decide its a problem.

thanks so much for that...i do not mind her reselling it or if she is making money from the sell...more power to her as i do sell my dolls at reasonable cost as i feel they are an 'emotional buy' . the only thing that bothered me was that she is telling people it is NEW and has just been reborn 'by herself" when it is USED. don't like dishonest people. guess they 'get theirs' some times down the road though.. thank you again for your time and you've been a great help.

You cannot judge if it is "used".  if she left it sitting in a box all the time she had it, it can be hardly termed used.  Practically all of the items listed here as new are in fact "second hand" as they were bought from somewhere else.

Dolls are dolls. 

Reborn Babies........slightly disturbing.

Ebay do have a rule about original art over $1000 and paying a percentage to the artist, but these are not selling anywhere near that.  Do you consider them art? (No offense intended).

If she is using your photos or listing description, report it and eBay will remove the listing.

If you sell them for $175 cheaper....she's not competition.

If she's lying in the her add, that's her problem, not yours.

To alot of people a reborn doll is more then a plastic toy.    Mothers who have lost babies buy them as part of a grieving process,  people who can not have babies buy them too.

Westernstar,    I can totally understand why you would be upset- Im assuming you would have put hours of work into this doll and Im sure giving the nature of the doll its always an emotional experience as well.  

 I guess legally there is not much you can do except send her an email,   and also watch and see if it sells for the price she is asking then maybe its a sign you could be charging more.        

Do you sign the doll anywhere with your artists signature?      Because the dolls are painted I wonder if it would be like art work,     in that case wouldnt she have to include the actual artist on her description?    Not sure but perhaps as a safe guard in the future you could look into this.        

People get all up in arms on these boards about counterfeit goods but Id be upset if someone tried to claim a piece of my artwork as their own.
