I sold an item and buyer didn't pay so I opened an unpaid item dispute buyer say's he will pay when he comes to pick it up
it has been several weeks and I'm still waiting.
because of time lapse ebay says I now have to close the unpaid item dispute, my question is
can I close the dispute without giving him a strike and get my final value fee back?

Only if you mark as that they paid = no FVF refund. Why would you not want him to get a strike?

Close the dispute as not paid,ebay will issue a strike & make sure you block them before relisting.
Like nova,I can't understand why you'd allow a tyre kicker to get away with this.

Just close the dispute and issue them a strike, you can tell them that if they come and collect and pay within the next X days you will ask ebay to remove the strike but otherwise it will be relisted.
Make sure you put them on your BBL now.

Just as a matter of interest, will ebay remove a strike for non payment on request?

Yes, there is a time frame of only 60 days after the date of sale though.
So, if you close the dispute and issue the strike for non payment you will automatically get a credit for the final value fee ( however you will still be charged all listing and insertion fees ) and if you do end up getting payment from the tyre kicker prior to 60 days after sale you can ring eBay or use live help and they will reverse the dispute, strike and credit.
It is extremely important that all buyers close an unpaid item dispute to A. get a credit for at least some of the fees and B. teach the tyre kicker a lesson that eBay is not a game because 3 strikes and they are banned for life.
