If a seller lists the delivery more than 8 weeks is this still covered by the ebay claim system

I have bought items from a seller who said the delivery would be about 8 weeks from Asia to Tasmania. If these do not arrive can I still claim through ebay or Paypal even though it is outside the 6 week deadline?
