Bought a product that lasted 3 days after contacting the seller he informs me that once the item is out of the box there’s no warranty and they won’t refund or send a new one
Please ignore the advice you have been given to open a fraudulent "not as described" return request. Nobody here should ever advise you the breach eBay policy, and those offering said advice most definitely know better.
You have stated yourself that the item worked as intended when you received it, but it didn't last as long as you expected. So by your own admission, the item was exactly as described when you received it. FYI... "not as described" does not equal "warranty". They are 2 very different and completely unrelated things.
Opening a return request using the reason "not as described" is a blatant misuse of the return process. This is not permitted under eBay policy, and doing so may well result in account sanctions for yourself.
You have a genuine warranty situation - on an item that has no warranty. On this occasion, you are simply NOT entitled to any compensation at all - despite the extremely poor advice you have received. At the end of the day, write it off as a lesson learned, and move on.
