No Returns

I bought a Kids bike for my grandson but after I was told they didn't have what I paid for and that I would have to choose something else for the same price I cancelled the order & got a refund (Thankfully).

But my daughter went ahead and bought a similar Kids bike from the same seller but when it arrived the bike frame was bent. Unfortunately she did not use PayPal and just paid by a bank transaction.

She & I both contacted seller & we told them it was made faulty at the factory & they said sorry no returns but we will send parts to fix.

When she told them that the frame was bent and parts had been welded incorrectly they said send photos.  So she took it to a reputable Motorcycle Engineer & had him take photos a write up a description of the needed repairs.

The seller then said that was not good enough & that they would have to speak to their engineer in China about it  & then speak to their bosses & get back to her. They were taking  weeks to get back to her so she thought well I can't send it back so I had better just cut my losses & get the bike fixed. The repairs cost her $200.00 dollars.

Now the seller is saying you must return it in the same box (which she no longer has) & that she will have to pay the shipping cost. They said that if there were any marks or damage on the bike when it arrived that they would deduct money from her refund to cover it.

So we both asked the seller just to reimburse her for the cost of the repairs & she sent them a 100% Legit receipt from the engineer who fixed it (with his contact info), but they said no. You either return the bike or you get nothing. Two weeks earlier they said  that there was no way that they would not accept any returns no matter what.

This seller is changing the rules after the sale to suit himself and my daughter is now out of pocket $200.00 bucks to fix the piece of junk they sent her.

Can anything be done about this or will she just have to put it down to a bad decision on her part and live with the consequences?

Was it an Australian seller? A business with ABN? If so, yes - go through Consumer Affairs.

 

Was it a seller not registered in Australia? You’re out of luck. Action could have been taken if purchased via credit/debit card, or through PayPal, but bank deposit has no intrinsic protection and is not considered a safe payment method because once the transfer’s gone through, that’s it in almost every circumstance.
