Returning a wardrobe

Good morning.I wonder if I could some advice as to my rights in this situation.I purchased a wardrode on the 8th November via Best Offer.

I paid for it via Bank Transfer same day.(I normaly use PayPal)I had a removal man pick it up for me last Saturday at a cost of $150.00.I could not go to the sellers place as my husband ended up in hospital.I was very upset to discover the damage to the wardrobe as it was not as described.It was so badly damaged it was unusable ie attached to a wall by the side panel with nails and screws! Then I discovered the dimensions were wrong.I got on to eBay and they contacted the seller as she would not respond to me initially.She had mentioned that she is within her rights to hold onto my money untill she has all the "bits" back in her possession.eBay did request  that she give me a full refund plus removal cost.I do understsnd I am not entitled to the cost of transportation only the cost of the item.The pickup was to be at midday this coming Sunday It has now been changed to 3:30 4:00.When I mentioned it was not suitable as I had arranged for someone to be home at midday she told me it was the later time or nothing..Am I entitled to ask for my refund via PayPal so I can get my money straight away?I feel so intimadated by this person I am afraid to do anything to rock the boat!

I have done all the things that I was advised and this seller still insists I am at her mercy and eBay are on her side.She has made out that I am the one at fault.

I have bought  to and sold items from long way away and used removal men without seeing the item and I have never had a problem. :((

Unfortunately you only have yourself to blame for this situation.

 

There is no buyer protection for pick up items on ebay. You are supposed to go to the house (even if you can't collect it in person) inspect the item and make sure it is as described before you pay. The seller has absolutely NO obligation to refund your money by any means and ebay will NOT have told them that they have to (or the operator has provided you with incorrect information - which is highly likely with the language difficulties and lack of training with call centre operators being located most generally in the Phillipines and India). So to say the proverbial, you are up the creek without a paddle.

 

A quick google search would have saved you all of this trouble. The exact same wardrobe from Ikea is about $700 dollars, brand new, guaranteed, and they deliver as well, probably for less than $150.00. It never ceases to amaze me that people do absolutely no due diligence for items they buy. It is well known that Ikea sells functional but low end items made from laminated particle board type stuff which doesn't lend itself well to being heavily used or pulled apart and reconstructed - unless you're particularly careful, which most people are not.

 

Mucking the seller about by refusing to acede to any requests is not very smart from your point of view. If they are turning up to refund you or pick up the wardrobe I'd be standing there at 2am if that's what they wanted in order to try and get my refund which is completely AT THEIR DISCRETION. Trying to argue to get it when it suits you just makes my hand itchy.

 

Yes they've done the wrong thing. But so have you. So sadly, it's going to be an expensive lesson, or try and have a bit of humility and make the best decisions to try and salvage the situation at whatever the cost to you in "inconvenience". And do google before you buy.
