Seller won't replace item?

I ordered a 252 colour eyeshadow set in May 2014 and when it arrived the case was smashed and some of the eyeshadows were damaged.  This occurred due to poor packaging, not from being handled in transit.  After many emails to and from the seller, he finally agreed to send a replacement product on the condition that I removed the negative feedback.  He begged me to remove the negative comment as he was concerned it would damage his reputation and future sales.  I removed the negative feedback and commented that he had agreed to replace the product, however it was unfortunate that I had to involve the eBay Resolution Centre.  Yesterday he said that he would give me a partial refund and I can then reorder on eBay.  I am over this guy.  I have reported him again to eBay; and I will never purchase from him again.  So buyer beware, he is not an honest seller and doesn't keep his word.

OK, Firstly never let a seller con/bribe you into changing feedback, once you do that some sellers are less likely to help you.

Now if you paid by paypal (i hope you did) go into your purchase history to the dropdown menu on the RHS of the page and click on resolve a problem. You should be able to open a claim for item not as described (you have 45 days to do this from time of sale). Once you open that you can explain your situation and you and the seller can transact through there. If you still get no joy, escalate it (you have 20 days to do this), in which case paypal will make a decision and rule in someones favour.. Take a photo of the damage just incase you need it.

 

Paypal might instruct you to send it back at your expense but if they do try to tell them it's not cost effective to do so.
