Hey guys, 


I had advertised a bag and stated i had bought it off ebay a year ago. Many pictures + and an accurate description + code inside bag. I specified no returns/refunds. I didn't state at any point whether it was authentic as i had no proof. I do believe it to be authentic. Most bidders (except for winning bidder) contacted me and i told them this. Buyer left positive feedback stating good product' and day after contacts for the first time stating it was fake and was going to raise dispute. What can i do?

As you had no proof it was a genuine LV you should never have listed in the 1st place & you're lucky the listing wasn't pulled.Fake LV's sell for a dime a dozen.


 


Re your current issue,if the buyer opens a Paypal dispute & can provide proof its fake,they won't even need to return & you'll be forced to refund the entire amount.


 


If they have to return it they will still receive a full refund including original postage as you have stated you can't prove its authentic.

The buyer if they open a dispute will have to supply proof to paypal that the item is a fake.


To do this they will need a letter on a letter head from a seller of that brand.


If they can supply this then PP will refund them and you do not get the bag back.


OR they will be told to return to you via registered post at their cost for a full refund.

You are probably better to ask the buyer to return the bag and just do the refund yourself as you are in a situation that you just won't win. If the buyer raises a dispute then paypal will take the money from you (or debit your account if you have no money in your PayPal account) and hold in while the case is decided. If the buyer has a message from you stating you are unaware of its true authentic then it's checkmate for you I'm afraid and PayPal will just refund them and they'll probably get to keep the bag as well.


 


the fact that you state no refunds means nothing - paypal's rules will override anything you say on your listing and you agreed to those when you signed up.


pid be pretty pi**ed if I bought a fake $500 bag I'd have to say - not that I'd be so stupid ever to buy a fake bag or any bag for $500, fake or not.


So you might as well swallow hard and do the right thing. Then either have the bag authenticated as sell it with the authentication, or if it isn't authentic, you'll have to throw it to the bottom of your wardrobe, or just continue to use it yourself. It's not right to be seen selling illegal fakes and the copyright holders of many of these items clamp down pretty hard on people who do the wrong thing - ignorance of the rules is no excuse to them.

As it is illegal, you know like against a law, to sell fakes, buyer has the right to assume that the bag is authentic.  If LV noticed they could have taken legal action against you, and you could have to pay thousands of dollars in damages plus all the solicitors costs. 


Count you blessings that you only have irate buyer to deal with.  Ask for it to be sent back, and refund full payment when you receive it.

OP, dunno what you got for the bag, why not just offer the buyer a partial refund?

the listing heading does suggest that its a genuine item


 


i was going to suggest to send the buyer the balance to whatever it owes you but i'd be better for you as others have said - do a full refund!

The fines for retailing NEW knockoff label products are huge, and can include a jail visit for the seller while all stock is siezed and distroyed by the Australian customs office.


It's why I refuse to ever touch the stuff even though i can buy as much as I like out of China for a pittance.


 


BUT, if you are not a retailer and are only trying to sell a one-off item that you genuinely believe to be the real McCoy and go about it by making it perfectly clear that you can't prove either way if it's the real thing or not the law can't touch you.


That doesn't mean that Paypal will let you off the hook in a dispute though.


 


I don't know how Paypal go about finding out if such items are geniune or not, or how they handle such cases because I've never needed to find out, so good luck with it all.
