Combined shipping question

Hi just hoping someone can give me some advice.

I recently purchased a bunch of items from Italy and the seller confirmed that they would combine shipping $2 per item. A few of the items sold for a fairly good price so when the seller did not reply for days or combine the invoice I assumed they were not going to go ahead with this and make me pay the $41 shipping per item. Based on their feedback and lack of communication I figured I would just pay for one of the items I wanted.

The next day the seller has sent me a new combined invoice for the remaining 8 items but is charging me $60 something dollars shipping so they are essentially charging the $41 again and $2 for each additional item. I've paid this total as a goodwill gesture but requested that they combine my first purchase of one item with the second purchase of 8 items and refund me the difference in the shipping , therefore refund me the $41 dollars shipping for the first order minus the $2 to combine this in the one order. Again the seller has not replied to me, they only write back with an "Ok" or "done" response so I don't know if I will get much cooperation from them.

My question is if the items all arrive in the one package will I be able to open a case and have a chance to get the $39 refunded or is there no hope seeing as I paid twice?

Language is probably a barrier.

If they processed and sent the first item because you only paid for that one, then you might be up for another initial postage cost as you will receive 2 parcels.

There is no case in eBay for over-charged postage, if they arrive in the same package.

You will simply need to rely on what the seller is prepared to do for you but you should have waited for the combined invoice or re-sent messages stating the invoice still wasn't combined.
