Misleading product description

Hey everyone,

 

I was hoping that someone could provide me with some advice. I bought a couple of CDs from a seller that were listed as "like new" condition. I checked the entire listing, and there were no other references to their condition, so I took it at face value. One of the CDs comes in a cardboard case so I sent the seller a message to ask if this was included and in like new condition too, and they said it was. So I bid on the items I wanted and won, but when I received them, I found that the items weren't as described. One CD had sticky tape and gluey marks all over the case. In addition, the back of the case was cracked, and the case was scratched and scuffed, front and back. The other CD (in the cardboard case) had multiple coffee stains on the cardboard. The jewel case itself was also cracked, and when I opened the case, the hinge was so loose that it almost fell straight off.

I sent a polite message explaining the situation to the seller.  He was rather rude in his reply and he told me that the "wasn't aware" of the stains or damage and that I got a good deal and should just be happy with it, otherwise I can pay for return postage.

Can anyone advise what I can/should do in this case? I feel like I've paid good money for products that very dishonestly advertised.

I've read these forums before yand you guys seem to know what you're talking about, so I hope to hear from someone soon.

From what you have described it sounds like the seller might be a bit of a £$%^&*@.

 

If the seller had been prepared to work something out I may have been more understanding.

Open a case for INAD in eBay (provided you paid by PayPal) and the seller will need to pay for return postage or refund without items being returned.

Looking at FB left for others Kopes it might be past the 30 day limit for an eBay MBG case, so the OP would have to go with a Paypal dispute. If they sign up for the limited return postage cost offer before that they'll get some if not all of the return postage back.

But that fb left for others is for only one CD.    And the fb was positive for 'like new'

 

The sale was 16th September

 

Where are the other CDs?     OP said the same seller..................???

Just to provide some clarification, I haven't as yet left feedback. I wanted to try and resolve the case amicably with the seller, although they're being quite resistant to interaction at the moment. That's why I wanted to get some outside opinions on what the best course of action is.

 

If you're looking at my feedback (specifically the one that I left today for the CD ordered on September 16, that's completely unrelated to this - a different seller, CD was exactly as described (i.e., like it had just come out of shrink wrap).

For me a lot would depend on how much I had paid. If it was only a few bucks then it would not be worth my time to go through an ebay dispute so as long as the CDs played OK I would find a couple of empty cases and move on after leaving appropriate feedback. If I had paid enough to make it worth while I would open an ebay dispute making it very clear that the items were not as described. If ebay find in your favour as they probably will they will instruct the seller to provide the means to return them and you will then get a refund.

Do the CDs work? That would seem to be the real test of their suitability. Of course I wouldn't know as the useability of a product, to me, is more important than the presentation.

I tend to agree with PJ.

What annoys me, even just reading your story, is the seller was specifically asked about one of the cases and didn't give an honest, upfront reply.

I hate that, it was his chance to say the CDs inside were 100% good but the cases had some wear & tear.

 

A lot depends now on what you want to happen.

-Were the CDs cheap or not?

-Were the CDs pretty good, do you still want to keep them?

If they were reasonably cheap & you would like to keep them, then get new cases but slam him in your negative-objective facts.

 

If you think you have paid more than you should have in the circumstances, the CDs are common enough & you could buy them elsewhere, then yes, open a case as kopenhagen suggested.

when i buy cd's i have several things when they arrive required for positive no complaints feedback,

1, do the discs look as described.

2, do they play without problem

3, were they cosmetically ok

4, were they well packed.

5 looking at the previous questions was the price paid to the answers to the 4 questions an ok.

 

cases often have cracks but as long as the disc is in good playable condition cases can easily be replaced.

 

unless a cardboard cover was a rare collectable the condition wouldnt bother me too much if the disc is in good playable condition. again was the price low or could i have got another for a slightly higher price.

 

as i allways rip every disc to my computer then never play the disc again, they are all in storage, thats all i care about.
