Does The Image Form Part of The Description of an Item?

Hi Everybody



I recently purchased this item 290804700034 and received an item identical to this item  160903781478.



It performs the same function, but the item I got is made in China and ½ the price.



Should I worry about it?.....Is it worth complaining?



Any opinions would be appreciated.

I'd agree a definite SNAD.



How about if you bought a 50" TV with a clear image of a Sony Bravia, (without stating it was such in words) close to a Sony price, and they sent you a no brand el cheapo?



The 2 units in the OP are poles apart in quality.

Got a message from the seller and have been having a bit of a discussion and basically he is aware of the item sent out  and believes it is a "better" item than the old silver one and is not interested in negotiating. Said if I don't like it send it back and I just sent a message about the postage, just to see what he says, but it doesn't look good.



So, that's that.

If the seller is running a proper business, paying GST etc then on an item of this value a 100% mark up would be expected. The cost of running a business in Australia is very high and after taking into consideration all costs etc the seller is probably only making a clear profit of a couple of dollars




Yes, I agree but, we are talking about retail prices here, I don't know what his buy in price would be, surely it would be cheaper than whats being listed on eBay.

Just curious.


Were you slow to pay or was the seller slow to post.


You bought the item on 8th October. Maybe you ummed and arrred a lot before coming here. Don't dawdle too much longer or your PayPal dispute window will close in about 14 days.




Yes, termalert, I live in a remote area in Central Queensland where the postal service is a rather hit and miss affair. I got the item on about the 23rd, but then had to go away for a few days as I work in the mining game at the moment. Forgot about it, then remembered, then ummed and arred if it was worth it, more just the principle than the need of the money.



Thanks for the heads-up though.




Oh! and also I have bought small packet items in the past posted from Brisbane that have taken over 3 weeks to get out here, they seem to get here faster from southern states for some reason.

Looks like a PayPal SNAD case for sure.


The seller has absolutely no right to substitute without prior agreement.


Open the PayPal dispute and ask for a full refund.


There is a provision for you to upload photos to support your case.


Upload his listing photo and your own photo ( taken from a similar angle ).


Sounds like the seller won't agree to refund but wait until he refuses and immediately escalate the dispute to a PayPal claim.


Blind Freddy ( and most his relatives who are PayPal employees ) can see the difference between what the seller had listed and the item you received.


You should get a full refund of all the money you paid but will have to return the item by registered post at your expense.

Not always - if a supplier decides to sell on eBay themselves often they sell at a lower price than the price they sell to their regular customers. This is quite common when dealing with the Chinese.



Hopefully the seller will offer to pay the return postage for you as they have admitted sending a different item.

So, you bought an item that had a different picture than the actual item you received? If so, that's worth raising an Item Not as Described dispute over, as it's simply not the item that was was for sale.


 


So, in that case, yes, the image does form part of the description as the specific car charger pictured differed greatly from the one received.

Termalert, That maybe there policy but i can assure you that does not always happen, In fact there is a case listed on here that some of these sellers have commented on , That they themselves purchased and disputed and received a full refund and item was never returned.  If you look hard on the forums im sure you,ll find it.

If you do a search on the two products you will find the one the OP bought is a brand name with a lot of information available on it, the one supplied is a no brand no info and the specs are  also a little different.



The one bought is rated at 5amp continuous with peak serge of 8amps and also comes with a fuse.



The one supplied only states 5amp with no info whether this is continuous or peak power and is not supplied with a fuse.



This is like ordering and paying for a Commodore and getting a Getz 



The seller has either made a honest mistake or is a rip off and feed back should reflect which if its the latter to warn future buyers they are not going to get what they bought and paid for.
