Dress was advertised as BNWT but is not new and has been used and has stains

I purchased a dress advertised as BNWT. The dress arrived and I can see that the tags have been re-attached. The lining of the dress has large yellow stains to both underarm pits, and another large yellow stain to the front of the lining. Clearly the dress has been worn and is not new. I paid $60 + postage for the dress. I do like the dress and I would like to keep it and try to remove the stains myself. But it is not BNWT it is used and so I'd like to know what partial refund amount is reasonable for me to ask for? I was thinking one third of the BNWT price, so $20 refund as the dress is used. Does $20 seem a reasonable amount?

It may not have been the seller who re-attached the tag(s). Often these sellers pick items up from garage sales, deceased estates, flea markets etc.. I have purchased items myself, advertised as new, that were not. They were re-packaged, resealed. Anyway, the onus is on the seller to check items before listing. Assumption while understandable is not good enough. A partial refund of $15 to $25 on a $60 purchase is not unreasonable as a request at all.

And it's highly likely a seller would have picked up the item from a garage sale etc - and have just the tags to compliment the garment. lol

The partial or full refund isn't up to you to think reasonable or not.

I'm really surprised that so many members are fine with breaching eBay policy.

Under the abusive buyer policy, requesting a partial refund without returning the item is NOT allowed.

It's already been proven that the OP lacks ethics, and has no issues with ignoring eBay policy. I'm just a little shocked by the number of posters who don't have an issue with breaching the abusive buyer policy.

I can't wait to see how the OP fairs after the seller hits that report button. I'm also very curious as to what (if any) action eBay will take against the people here who are giving advice on what they consider an appropriate amount to request and in doing so, breaching the policy.

Time will tell, I suppose.

Just to further clarify, here is a C&P of the abusive buyer policy (to save time reading through the whole thing, just read the bold text if you like);

Abusive buyer policy overview

This policy outlines our expectations for buyer behaviour. When buyers don't meet these standards, sellers can report abusive behaviour - opens in new window or tab.

Engaging in the unacceptable behaviour outlined in this policy may result in a range of actions, including issuing warnings to buyers, blocking buyers from requesting returns or refunds using the eBay platform (noting that this does not prevent a buyer from exercising any legitimate right under the Australian Consumer Law), blocking buyers from opening claims through eBay, and account suspension.

When we review a report of a member violating our policies, we look at the circumstances, including the member's history. We make decisions based on the evidence in the individual situation, as well as by evaluating patterns of behaviour that create a negative experience for users of eBay in the marketplace. If we aren't sure about something, we may not take any action. Also, because we respect our members' privacy, we do not discuss the results of any investigations.

Behaviours we don't allow

Don't demand something not offered in the original listing

Not allowed
  • Requesting a postage service not offered by the seller
  • Requesting that the seller post to an address other than what you included in checkout
  • Requesting to use a payment method not offered during checkout
  • Requesting that the seller hold your item so you can pay later
  • Requesting a partial refund without returning the item
  • Requesting additional items or services not included in the original listing or asking for a discount
  • Finding an item on eBay and taking the sale off eBay

There's nothing to stop the buyer and the seller coming to an agreement which is suitable for both parties without a full refund/return. Sellers can definitely offer a partial refund to the buyer through an open case and is seen as an acceptable way to settle a dispute.

Of course a seller can offer a pertial refund. Where did anyone say they can't??

The point here is that the BUYER is not permitted to request a partial refund without returning the item. It's there in black & white for the whole world to see, so there's no point disagreeing with it.

Why would a buyer return an item for a partial refund?

Where's the link, if it's there in black and white?

https://www.ebay.com.au/help/policies/rules-policies-buyers/abusive-buyer-policy?id=4374

It is written there - I suspect this is to counter the common practice of people trying for post-sale discounts, the way some people have been doing for years, but I also suspect it's been written poorly, in typical ebay style. This practice (asking for partial refunds) is usually responded to by sellers with the instruction to return for a full refund instead (as mentioned, it's what I do), but the buyer tends to point-blank refuse to return the item for a full refund (and often that's because the buyer is angling for said discount, not genuinely complaining about INAD), so I think it might be trying to address that specifically.

In other words, if you approach a seller and ask for a partial refund, but do not refuse to return for a full refund if that is the only resolution a seller offers, it's probably 50/50 whether that would be considered a breach of this policy - probably depends on the rep you speak to on the day and how they interpret it, as per usual. 😅

Edited to add - that aside, I'm pleased to see ebay actually acknowledging and trying to counter these behaviours. Another point to them for seller-friendly adjustments.

Thanks Digi.

Never been asked for a partial refund - mainly because my items are low value.

Same - I usually get this, instead:

Them: "This item is (some version of INAD) - I want a refund"
Me: "Ok, no problem, you can return to [my address], I'll be happy to provide a full refund and return postage will be covered"

Them: "I've already thrown it away - no return, just refund"

🤣
