Fake product on eBay legality?

I bought a fake  iphone glass back cover  on  e B a y   the seller advertised it was a genuine product ,I would like to know if I am obligated  to pay for return postage to get a refund?,there are other buyer who also clamied the product was a fake and it does not function properly.Attached is a photo of the original product and the fake is on the right hand side.

Is the seller in Australia? If so then you can try emailing them and telling them that you have received a counterfeit item and unless they refund you within 48 hours you will report them to the right's owner and the police. That may scare them into refunding but if they are a practiced scammer or actually overseas although they don't appear to be they will just tell you to go forth and multiply or send it back for a refund.

 

Your other option is to open a Paypal dispute for item not as described, presuming you paid that way, unfortunately unless you can get 3rd party confirmation on company headed notepaper that the item is fake you will still have to pay to return it by trackable means.

Yes, it looks different from the original, but I'd still be trying it anyway and if it works as expected, I think I'd be saving myself an awful lot of grief and ignoring the fact that it may be non-genuine. All that really matters is whether it works or not.

However, if it doesn't work, I would be lodging a Paypal dispute and claiming SNAD. If you really want to go the counterfeit route, it means getting third party written confirmation (probably from Apple themselves) and I'm not sure they'd be all that inclined to help you anyway, given that you didn't buy it from them in the first place.

I'm guessing that you probably knew it wasn't genuine anyway because the only place you can be certain of buying genuine Apple parts is from Apple themselves, so whatever happens, look upon it as a learning experience and don't get caught out again.

To use non genuine parts on anything is fraught with danger

Could do irreparable damage โ€ฆ if under warranty, would/could in most cases void the warranty
.
If it was sold as a genuine article and is counterfeit โ€ฆ Do not use it !

If a seller is prepared to deceive you in the description then they are prepared to deceive you in the quality of the product and it would be guaranteed to be substandard

That's quite a ridiculous i'll in formed blanket statement.Smiley Sad

 

 

I take the utmost offence at that statement, please prove my parts are not as good as genuine, and prove to me the danger using

 

aftermarket parts in my field or retract your outrageous statement.

 

 

I'm happy to provide 1/ 2 years warranty, some items 10 years, in most cases you get a limited warranty if any on genuine parts in my field.Smiley Indifferent

Also sellers of non genuine/counterfeit products can sometimes use deceptive advertising

They may use expressions such as:

A Brand New Evinrude Johnson Outboard Starter Motor
.
When in fact, it is NOT an Evinrude product โ€ฆ it may fit/suit an Evinrude โ€ฆ BUT โ€ฆ is not a genuine part โ€ฆ

.

But the title gives the impression that it is !

Thus misleading โ€ฆ and really should be reported to ebay

So you would have me say  'Brand new outboard starter motor suits outboard"  in my decription it tell you, nothing to hide here.

 

But i could understand how that would confuse you, your mind set is one size fits all, hence your blanket statement about non genuine parts. lol
