I recently ordered a harp from a uk seller who listed the harp at considerably lowered price and shipping cost. But I think he is a scammer. The reason why is because he called me from new york to ask for my email address so that he can send me photos and video of the harp. Realising that this seller is bit suspicious I requested to cancel the order and refund my money before it is even posted. He agreed and said he'll refund me by yesterday but he did not keep his word and did not reply to my msgs demanding prompt return and refund. I didn't know what to do, I opened return case before the harp was even posted and ebay said I'll get my refund once the harp is delivered to the seller but in the case I return an item before it is even sent to me for change of mind, what will happen? How can I get my money back from this seller

If the seller is on Managed Payments, I think that being new he won't get the money until the item is marked as delivered or the buyer (you) leaves positive feedback. I am not a seller, but I have heard this to be the case with new sellers, and I suppose it is the same in the UK?
So I think right now eBay might have your money and I don't think they will release it into the seller's bank account until the transaction is considered successful? I am not sure, but I have heard new sellers say that.

Yes most likely a scammer.
But why should Ebay give the money back, before the expected delivery date, Surely you need to take some responsibility as well, and wait for that time.
You have done so many things wrong with this deal, just wait the required timeframe.

There is no way I am leaving a positive feedback to a seller who doesn't deserve it nor would I mark or let them mark item
delivered when it isnt. That is the most ridicous thing I've ever heard, to force buyer to lie to get their money back! They should simply allow buyers to cancel order item when it is not sent yet. Also the seller is not new, he supposedly sold items before I purchased from him as his other listing of harp has marking that 1 is already sold and only 1 is left

No, you don't have to leave positive fb to get your money back. The seller, being new, won't get HIS money unti you leave positive fb or the item is delivered (with tracking confirming delivery(.

So how do I make ebay refund my money? How do I let them know that there was an agreement that order was to be cancelled and buyer to refund my money? Also I don't think ebay is holding the money as seller spoke as if he was able to process refund without ebay stepping in

That seller has no feedback for buying or selling and only registered early this year, so yes they are "new".
As said before this could be a highjacked account, given they are selling high-priced items with no previous history.
This could be a very difficult mess to get out of, but whatever you do DO NOT open a chargeback with your bank or both that and the eBay dispute will be closed against you.
In future to give yourself the maximum buyer protection, open a Paypal account and pay with your credit card through that.

Nope. All you will succeed in doing is having the dispute closed against you and you cannot reopen it.
You have already jumped the gun in asking to return the item before you have received it. Just wait and hope that it arrives before the Return request times out.

You are not getting this. I have already told the seller I want to cancel the order so it is unlikely seller will post the harp which means I will never get a harp to return
