I Understand everything you said.
He did refund my money and he was very kind towards me. I got lucky this time. He even made sure I didn't get a strike.
So my problem is fixed.

I have contacted seller and have apologized and am willing to pay for the listing fee.

Just because it hasn't been marked as sent, it may have been posted already.

The seller is not obligated to cancelling but if you have struck a nice seller, they may refund the payment and send you a cancellation notice for you to agree to. That will free you both from the transaction.

Providing it's not posted yet.

Hi. Probably 5 minutes after I committed I messaged seller asking to refund money and I would pay for listing fee.
There is no way he would of posted already As post offices close at around 5 pm.

they do but the red post boxes are open 24 hours they could have easily just dropped it in one of those.

maybe not, but they may have already purchased the postage via the ebay / aust post site, and paid for it.

 

on top of that a seller is given a defect against their account if they refund and cancel sales, so you are not only costing them final value fees (over 10% with paypal costs), but you are also putting their sellers a/c in jeopardy of being defected by eBay.

One thing you have to keep in mind is that some sellers read and respond to messages at only certain times of the day, so even though you may instantly send a request, many prioritise processing and packaging orders, then attending other admin at the end of the day, only first thing in the morning and so forth - I recall sending a seller a message about 30 seconds after payment because I realised I had provided my PO box address for a very large parcel when I mean to use my street address. I was willing to do all the right things so that the seller wouldn't have to compromise on anything or lose out, but they posted the package hours before they read my message. 

 

In saying that, if the seller accepts returns, regardless of whether they have posted the item yet or not, they should be ok with either cancelling the order or accepting it back if they already posted it, minus any costs incurred.

Sorry, that's not correct.

 

As kopes said, the seller can refund and send a cancellation request.  Since the buyer has been so apologetic and up front, I'm sure they would agree to the cancellation.   This would not result in a defect, and on the off-chance it did, would be grounds for removal given the email exchange.

 

It has been noted on these boards many times that if there has been communication between the buyer and seller, a refund does not result in a defect.

 

The seller could also refund minus the listing fee as the OP has offered (and I would also suggest the 30c paypal fee, which is also not recoverable by the seller) - partial refunds have also been shown to not result in defects (I can vouch for this).

Cancellation reasons:

 

Buyer purchased item by mistake or changed mind

 

Sellers don't get defects for those

Without meaning to be rude, I don't see that the question of when the parcel could have been posted comes into it.

You committed to buy, then suddenly changed your mind and let's be honest, no one can make you go ahead with the purchase if you don't want to.

 

But in the same way, the seller does not have to accept a cancellation either. From what i have read, there can be difficulties with cancellation requests where a buyer does not respond, so you may have struck a seller who is no longer prepared to spend time on cancellations, but will just wait 4 days and lodge an unpaid item dispute.

 

So even if they got a message 5 minutes after a sale and even if they had not posted the item, they are perfectly within their rights to refuse to cancel. Some sellers may do it as a courtesy but they don't have to.

 

Let's face it, even if you refund their listing fees (plus their paypal fee), you have still put them to some bother, they have to sit there and fill in online forms, check that everything has worked and they have been reimbursed etc. You've wasted their time and you expect that just paying back the fees will be enough.

 

You sound like a decent enough person and polite enough and for sure, a lot of sellers might be prepared to accommodate you, but you may have to accept the fact some won't and that sometimes there are consequences for bidding and not buying. You may cop a strike.
