Help Needed: Buyer Claims Received Wrong Item (DJI OSMO Pocket 3 vs. Pocket 2)

I recently sold a DJI OSMO Pocket 3 on eBay. The buyer has now initiated a return request, claiming they received a DJI OSMO Pocket 2 instead. They also uploaded a picture of a Pocket 2, saying that's what I sent them.

I am 100% sure I shipped the DJI OSMO Pocket 3, as listed in my eBay listing. Unfortunately, I did not take any photos or videos of the item or the packaging before shipping.

 

I am concerned this might be a case of buyer fraud, as I cannot think of any other explanation for this situation.

 

What steps can I take to protect myself in this case?

  • Should I escalate this to eBay, and if so, what evidence can I provide?
  • Is there any way to prove that I sent the correct item, even without photos?
  • Has anyone faced a similar issue, and how was it resolved?

Any advice or insights from the community would be greatly appreciated!

If the buyer opens a dispute I don't like your chances of winning with no photos of what you sent.

 

It might be better to offer to accept a return where you pay the postage back and refund when the item arrives.

I am with padi on this one.

I am not sure you can prove it. Even if you had photos of you putting the thing in a box, it isn't necessarily proof that that is the box the buyer received.

 

Yes, others have had this sort of thing happen before. I wouldn't say it is common, but it does happen from time to time.

 

Usually, from what I can gather from posts, the seller loses. Ebay often decides in the buyer's favour.

 

The one thing that would help would be if there had been photos of any serial number in your ad. I don't even know if those items have a visible serial number but if they did have, then if something with a different number was returned to you, you could alert ebay to a problem.

 

Just one question: Do you own or have you ever owned a pocket 2?

If not, then yes, it definitely is a case of buyer fraud.

 

In the dispute, you could mention (if it is true) that it was definitely a pocket 3 as you do not own and have never owned a Pocket 2 and that this is a case of buyer mistake or fraudulent claim. At least it would be on record. But I think you will still need to pay return postage to get the item back.

 

If the item you get back does not match the photos you put in the ad in any way eg scratches where there were none in the photos in the ad or whatever, then it would be worth raising that issue with ebay and providing photos of the evidence.
