I'm nont good in English however I need someone give me opinions for this case. I have ebay id for many years but I rarely used it. I am looking for my new mobile. Recently, I get a problem with a seller.
Previously, I bought used mobile and found that mobile had a problem. I contact to mobile's manufacturer, they want proof of purchase to fix it so I dealed with seller, but no reciept so i return and got refund. There is no problem. I had paid my own cost to return. Thanks for the good seller and i had learnt a lesson. If a mobile has a problem, even it is under warranty. It need proof of purchase otherwise it is no warranty.
Recently, I found new phone. It said brand new, seal box. The information was not enough for me to decide to bid the item.
I contacted the seller. I got answers that It is local stock, bought from local retail shop and he got this phone for his replacement the original phone but he didn't reply me the question that he didn't have reciept even i mentioned that do he has a reciept when i have a probleem with the phone i can claim to manufacturer. I thought he had reciept as he replied this way. After i won bidding, I contact him again and remind him to provide proof of purchase the phone as i asked before i decide to bid his phone. He just sent invoice but no answer. I asked again about reciept. Finally, he told me he has no reciept and he never have a problem to claim without reciept so i replied him that i don't pay if he cannot provide proof of purchase. After that, he didn't response me even i contact him again to cancel transaction.
Sorry about long information. I don't know how to deal with this issue. It seems if i pay this phone. I pay too much for the phone which is no warranty. I thought i think carefully before buying a thing on ebay.

Don't worry about losing your eBay account - it won't happen with one unpaid item strike against your name. There are some terrible buyers out there with plenty of unpaid item strikes and eBay doesn't seem to do anything about it.
Also remember that sellers cannot leave negative feedback for buyers.

There really are some things that you just shouldn't buy on eBay, (or online) and mobile phones are one of them, for the exact reason you have found - the warranty.
I would not usually advocate this as you have entered into a legal promise to buy this item, but I believe that you did do so with the best intentions.
SO, I am going to say don't pay. However, this opens you up to the seller opening an unpaid item dispute against you.
If you are confident enough in your english communications, I'd give eBay a call, and explain the situation to them, just so it's on your file.
If you pay, and the phone is broken, then what? They don't seem like the most honest seller out there. But, maybe like you English isn't their first language either and misunderstood your question.
It really is a toiugh one, as you really should pay - but.......
How clear was your message asking for the receipt before purchase?

I asked two questions. Is it Australian stock? Do he have the reciept of this phone in case there is a problem It can fix with xxxxxx Australia.
I think it is clear question and I got these answer.
"Yes it is. It was actually a replacement for a phone I bought at xxxxx in Australia. Xxxx Australia replaced it when I had issues with my original handset a couple of months ago. I have had to get a new phone for work because I need a specific app not available in the windows phone store. The warranty will be valid for ~22 months from now."
Is my understanding wrong? I asked these questions to other sellers either. If they said they don't have or they could give if it is necessary as they use the reciept for their business purpose,I wouldn't go for bidding.
Thanks for your opinion. I also afraid that he would go unpaid case and I will lose my eBay Id. It is my big mistake.
