Hi, I have received a item today that I need to return as it is not as described. I emailed the seller and they have told me to return the item before the 16th January for a refund, the problem is that the parcel took 11 days to get here today and if I post it tomorrow, I am worried that it will not make the deadline, as postage is slow from Western Australia.
Can someone please tell me if it does not reach NSW on that date will I lose my refund.
Also do I pay for postage to return as there was no mention in the email who pays, it came in a 5kg prepaid bag so not sure what the costs will be to return to the sender.

Hi Maddie; I'd try for the letter first - just gives you something on paper to fall back on! Just my opinion though! Lyndal would know more about this than I do! She's the more experienced person.

I agree with redders.....try for the letter first.
If you cannot get it you will have to bluff the seller as you will not be able to relymabsolutely on ebay backing you up although it is well known that they usually rule in favour of the buyer.
What is the size showing on the shoes? Is it exactly what was advertised in the listing or is there a discrepancy? Were there any measurements in the listing?

Forget my earlier suggestion of on selling them if they are fake. Ebay are more willing to accept an item is fake than Paypal and if you can clearly see a difference and take a photo of them side by side they may accept that if you cannot get a letter which is rather difficult.
I would phone ebay and explain that you have found out the are counterfeit and say you can send pictures to show the difference, they may accept that and refund you without you having to return them.
I would also message the seller and without accusing them of knowingly trying to scam you explain that you have been to the shop and confirmed they are counterfeit and unless they refund immediately you will be contacting Clarks and passing on their informatio.

Sorry to hear about this latest development.
Do you have a scanner? If / when you get the letter, I'd scan a copy and send it through to the seller. As mentioned above, they may not be aware, but if - once you have provided the written confirmation - they're not willing to work with you for a satisfactory resolution (in my opinion, that would be a postage-paid return for a full refund of the origonal payment), I would upload the scan to the request console, and then contact eBay by phone for further advice, as sometimes requests involving fakes are handled differently than other types of not as described requests.

Hello. I am the seller.
I just want to add a few things here.
I have already agreed to take the shoes back and issue a full refund before this thread even poped up.
The shoes are NOT fake but may be a sizing error.
Further more the only people qualified to determine if thier product is a copy or "fake" is Clarks themelves not some girl in a shoe shop who just scored a sale herself. Probably also added something along the lines of "gee thats whay you get when you buy from ebay. you should have come to us."
Anyway there is no problem here as the return process is well underway

Just curious, but if it turns out to be a sizing error would you be refunding the OP's return postage?
