If it's too late to lodge a Paypal claim and the seller refuses to refund your money, all you can do now is to leave the appropriate negative feedback (remember that you only have 60 days from the purchase date to do so).

If you're really lucky, the seller may even offer you a refund if you revise your negative to a positive, but if he does, make absolutely certain that you receive a full refund before you revise your feedback.

Unfortunately I'm in the same boat! The item worked just once, when we tested it, and when I contacted the seller, they asked me a whole list of questions but said if it still didn't work, they'd refund me my money. I had to speak with someone else about it and now they don't answer my emails, they've blocked me from their e-bay store and I can't find the id # on ebay to lodge a complaint with the resolution of case section. Looks like I've lost my money and scored a dud item. Emo-Tree? You suck big time!

Promises and assurances are a dime a dozen, and unless a situation with a seller has been resolved by the 45th day following the sale date, it doesn't matter if a seller has promised you the earth, you absolutely must lodge a Paypal dispute. You have a further 20 days in which to escalate it, and you can close the dispute at any time if the problem is resolved in the interim, but unless you lodge within that 45-day window, the opportunity to do so is lost forever. Once that happens, you've lost all leverage you may have had against your seller and your chance of reaching a satisfactory resolution to your issue is now slim to none.
