In 2013 December 25 I bought a boxed set of DVDs for a gift. 3 of the six DVD containers were empty

As this was agift and unopened until recently the problem has just been found

I contated the seller twice but no response

Is there anything I can do after such a lapse in time

The product was Kennedy Miller Presents Great Australian Stories 

I think I would have paid PayPal along with other items which I have since checked and were OK

Major rule when making a purchase,  both online and off. Check what you have bought to make sure it is complete and suits the purpose it was intended for. No one is goingto give you a refund after 18 months, not even K-Mart or Big W. You could contact Fair Trading to verify that.

 

The sick/disabled family member is the oldest line in the book. Not saying for a minute that your husband wasn't very ill, but the sick/disabled excuse is the commonest card to play. Most sellers will dismiss those excuses unless you can show them medical records or a death certificate. 

 

You are not the victim. You had 18 months to check the contents of the box. If you'd contacted the seller within a few weeks of purchase, they probably would have bent over backwards to help you. After this amount of time how does the seller know they didn't get wrecked and you're wanting a freebie?

Hey I bought for my husband and he became very ill

Th gift was not a proirity  at the time and was overlooked

 

This can happen when we are going through stressful times. Sometimes other things do just go to the wall.

But in all fairness, this is not the fault of the seller.

After the set arrived, you probably had a month's grace in which to check out the set.

I've often heard people say things along the lines of "I didn't have time to do it'. I've said it myself.

It's rarely true. Checking out your set of DVDs would have been the work of 5 minutes.

Yes, you were. But it is too late now to do anything and part of that is your fault.

No, but we don't know that that is what happened in this case. If the set was unopened, the seller would not have known any were missing. And after more than 18 months, they are probably wary of getting into any discussion with you. They may think you are trying to rip them off!

If it was deliberate, they would definitely not be willing to deal with you.

 

It is what it is. I know you feel disappointed but you didn't check at the time, it is too late now, all you can do is move on, maybe see if you can get the missing DVDs elsewhere.
