It's been 39 Days since I paid for my product, I don't have it yet, what do?

So I purcahsed a product from a seller in China, it's been 39 days since I paid and they keep telling me that there's a delay in shipping, should I wait till the 45 day limit before making a clam? I've purchase many more products from China since then and have recieved them. 

What should I do? if I wait too long will I lose my ability to make a clam?

Mail has been delayed from china. Most of my stuff turned up 35 - 50 days.

Everyone on here advised me to open a dispute by 43 days at the latest, no ifs, buts or maybes.

Contact the seller, tell them it has been 39 days and you have not received the item and you would like a refund. Tell them, if the item arrives you will repay the money to them. I have done this many times, some times the item turns up after 60 days. Most sellers are happy to do this. If the seller does not reply, or you think they are scamming you, open a case.
