Item sold as working. but it is not. please help me

Hello everyone, I may ask your help guys because I do not know what to do.
I bought from a vendor, one retina screen LCD display used for my macbook because mine broke.
The seller assured me that the object works 100%, but in reality once i plugged in, it is not. ( actually the screen works but it does not work the backlight).
I had already asked him if in case it does not work if I can return the item and he reassured me and said "yes, only if there were no damages".
Now after I have contacted him and indicated that it does not work, he says that I have done something wrong during installation (but it is not true, because I am technician hardaware from 6 years...) so at this point is my word against his.

Now no longer responds to the messages that I send him .
The payment was made ​​through paypal.
I think that I have been cheated by the seller or maybe he didn't know(?).

What can I do now?

The cost of the item is expensive $300 plus $ 10 shipping.

Just as a note while you are here,postage to W.A is always slower & if you live there you should already know that.Your feeback left for others mentions that a few times so i hope you are not marking down those sellers for postage times with that.

Either pay extra for express or patiently wait longer for your items.

When you open the dispute give as much information about the fault as you can, use technical terms if you know what you are talking about, as Paypal base their decision on the communication between you and the seller. They do not always find in the buyer's favour and if they don't you may need to call Paypal and keep insisting on talking to a higher staff level until you convince somebody it really was faulty on receipt.

Paypal do indeed arbitrate on not as described cases, it is simply not a given that a buyer can claim not as described and return them.

To claim so is irresponsible and misleading and may cause some buyers not to supply appropriate evidence in their dispute or claim.

The item I received from you was not working completely.
The backlight of the LCD screen is not working.
You told me before the purchase through private messages that I could return the item if it does not work.
And now that I've informed you that the screen does not work, You do not accept the return and not even answer anymore to my message that I write to you.
In friendly way please let accept return of the item (undamaged and as you've sent me,I took detailed photos.).

If you are in the first stage of the dispute process - where you are still communicating to the seller via the dispute console- the above is ok. 

 

Though I would not say you are seeking to return the item "undamaged" I would say that I am seeking to return the item "in the same condition as received"

 

 

If or when you are escalating to a claim then only paypal see the notes and you are best to upload copies of the messages between yourself and the seller and the photos clearly showing the product fault if possible.

I hope you've kept copies of all correspondence between yourself and the seller prior to purchasing the screen, particularly those messages where he indicates that he will accept the return of the item if it proves to be faulty, as you will probably be required to upload those messages to Paypal in further support of your claim.

Ok here we are, this is the answer of the seller after my previous message:

 

 

"I really really really believe buyer has damaged screen trying to install it,screen was tested right before postage and was working 100% ,so screen would be no good to me damaged."

 

 

 

I forgot to say that the seller in the private messages mentioned that screen have been rremoved from a laptop with water damaged logic board.

how can he test it? not even the apple store can test it. now i understand he is clearly trying to rip me off.

Anyway the screen has ANY damage to anything , cables connector included.

Also i haven't give him a feedback yet.

 

So now what to do next ?

OK, your seller clearly believes he's going to win the case if he's escalated it himself, so all you can do now is to put together as much evidence as possible as to why you believe the screen was faulty when supplied and then leave it up to Paypal to arbitrate.

At this stage it's your word against his so the result could go either way. However, buyers seem to have more success with disputes than sellers (what a surprise!) so there's a reasonably good chance that your claim will be successful, even if Paypal end up making a discretionary payment so that neither of you end up losing any money.

If you do ultimately lose, you can always let Paypal know that unless they reverse their decision you will refer the matter to the FOS as this often has the effect of making them change their minds, probably due to the rather large fee involved in fighting a FOS dispute.
