A few more detail are necessary to give a proper answer.
In what way are the photos misleading and what does the description say?
And how do you know they are misleading....have you received items that are not as descrbed

What Lyndal said.
It probably depends on what you mean.
If there was a fault not shown in photos, that could be cause for dispute.
But so much depends on the written description too.
For example, I have seen buyers write an item was smaller than they thought it would be. If sizes are mentioned in ads then the seller should not be responsible for people misjudging size based on close up photos.
If an item is photographed with other things that are not included in the price, that could be deceptive or misleading.
You'll need to tell us what happened in your particular case.

I think sellers need to be so careful with photos and really stand back and consider what is showing.
Even quite innocent staging can lead to buyer misconceptions.
For instance, I recently bought a little wedding horseshoe type thingy. I read the ad, I looked at the photos closely and I couldn't work out why on earth the whole thing wasn't showing in the photos.
Then when it arrived today, I realised I had been a bit dopey. The actual wedding charm or whatever they are called had been photographed in front of a floral bouquet. But of course sizes aren't always clear in photos and for some reason I had imagined it was a tiny heart inserted in a couple of little artificial flowers.
No harm in having an attractive backdrop but I do think it is probably important to photograph the item on its own also.
In my case, no harm done, perfectly happy with what I got but it wasn't exactly what I had (wrongly, I know) visualised.
I saw a case recently where a person was selling a bowl for a thermomix and said so at the bottom of the ad, but the photo showed the whole thermomix & even though i read every word of an ad, I was mistaken at first. I noticed that it sold at a high price but then was relisted next week, this time with revised photos. I suspect whoever won the first auction had thought they were bidding on the whole thing.

I have listed a few things with a coin to show size comparison. I had one buyer contact me after they received their item saying they were happy with it, but they didn't receive the coin. It shows you have to be REALLY careful with photos because we sellers know that more often than not, buyers look at the title and photo and don't read the descriptions (I wonder sometimes why we even bother writing them half the time). Therefore, it could have been assumed by the buyer that they were getting everything in the photo.
Now, if I want to show a size comparison, I still sometimes use a coin, or I'll show it near a tape measure. I write in the description that the coin or tape measure is not part of the sale (and hope they read it!).

If you do a search for "Solar Kids with Fireflies Statue" you see pages of these things. Most of the photos are of the first one with the clear glass jar with the decorative fireflies inside. When you get to the end of the photo sets you see the other one (which is the one they're actually selling.

Please, don't drag up a 6 YEAR OLD thread when you've already had an answer on yours.
