Have been talking with seller since 30 Aug - about my item that hasn't arrived. Seller said they opened a dispute with Aust Post and that I would have to wait till 19th Sept to hear the verdict (either he will refund me or aust post finds it) - but still no answer even now. Am unhappy, seller is well trusted - now i cant leave feedback or anything as my item is in archives.
Can anyone help me?

If you paid by PayPal you have 45 days from payment date to open an Item not received case.
That gives you a further 20 days before needing to escalate to a claim.
You can open a case and if it arrives you simply close the case, but don't miss the 45 day deadline in future.
You have 60 days to leave feedback. Hover over account tab and select feedback there.
It stays a little longer there.

Open a INR case with Paypal STRAIGHT AWAY. Do not let the seller string you along anymore. DO IT NOW.

If the seller is talking with AP then it is reasonable for you to give them a little extra time to try and trace it, if you haven't received anything by the end of this week I would open a Paypal dispute, presuming you paid that way, tell your seller you will give them another 2 weeks after that before you escalate to a claim.
I have no idea why you would be wanting to leave feedback before the dispute ended as I hope it wouldn't be a neg because of AP's inefficiency!

I certainly would not leave negative feedback unless justified - I was worried because it had disapeared - I couldnt find it anywhere. I was told to wait till September 19th to find out AP findings - and am now out of time with both ebay and paypal for dispute resolution.... Am being asked again to wait by seller - although he is now saying no refund, as per ebay policy - where as he did offer in begining - also; I did recieve my item from same seller last time no worries - am not a gun jumper for negative feedback- but late July to now is just ridiculous to wait. Now I am stuck without my very collectable item, which I would prefer 1000 times more than the refund... I wont leave feedback untill this is rectified.
Just worried and frustrated...

If you purchased the item at the end of July you are right....you have no recourse from paypal and you are also too late to leave feedback.
The seller has strung you out past the cutoff time for opening a dispute and will not refund now that he does not have to.
