Hi all , today i had a dispute closed and in the favour of the seller.
The dispute was that the item had not arrived----it still hasn't.
There seems to be no avenue to dispute this decision , they(paypal) only allow a challenge if item is recieved and NAD.
In my case it hasn't arrived.
The Paypal conclusion was that the seller (USA) had provided proof of delivery and that was that.
This delivery required MY signature , and i have never signed for, let alone seen the item.
Any suggestions

Anyhoooo , today i phoned 1800 # and left on the note that management would phone me soon.
It appears someone unknown had signed for delivery (taken from Fedex track site) and Paypal acknowledge that person was not me ---so good so far.
One thing that still irks me, is that someone else signing for the delivery of an item might please the courier ,but it takes away my opportunity to inspect a suspect (damaged parcel) to OK before i sign it off.
Any thoughts?

I am assuming that you are referring to a clause that says that you must open and inspect a damaged parcel in order to be able to make a claim....or something along those lines?
I know of no courier who will stand there and wait for the customer to open the parcel...there is just not the time for that.

I don't know what the position is in Aus but here in the UK if a parcel shows any sign of damage you need to write that when you sign along with the words not inspected. Of course unless you have arranged the delivery yourself the onus is still on the seller to sort it out if there is damage.
Back to the OP, yes it is important that everyone knows it is not an ebay transaction however if you ticked the box to say you were paying for goods you have the same level of buyer protection however the seller does not have the full cover that they have if it was an ebay transaction, the main difference is the lack of protection from bank chargebacks.

I agree that i normally just sign and accept , but murphy's law is always lurking. In this case i didn't sign or recieve the item , so if it turned up later i guess i'm done.
Haven't heard back from Paypal yet , but like you said PJ i'm probably covered by buyer protection----we'll see.

Hi Appeal was resolved and i was fully refunded.
My appeal was that even though the Fedex tracking site showed the item had been delivered it also showed i had not signed for that delivery.
They agreed , no fuss , no ombudsman needed.
