Refusal to refund monies

I bought a "Michael Jordan - 1992-93 Topps Stadium Club Beam Team #1" hobby card from an American Seller which was received by my local post office from tracking details on 8th October 2014 and I subsequently picked up the item. Upon inspecting the card, have noticed damages on the card and notified the seller immediately to arrange for return and refund, which occurred on 18 October 2014. The item was damaged, I have returned the item where the seller originally agreed to refund the monies.

However, to my dismay, he did not respond upon receipt of items on 29 October 2014 to indicate refund. Upon contact with EBAY Australia and USA (at the time within 45 days of sale purchase, EBAY would NOT accept when I click on the link "RETURN" item because the seller was on a different server/site - whatever - that's bs), he then contacted me via EBAY messaging to give him my details for refund but responded with sarcasm and cockiness (if there is such a word - "Wow you Aussies are something else" and "I'll refund You on paypal so you'll quit freaking out"). And I responded within 48 hours of receiving this message.

BUT, this is not it! 

He relisted the item without my knowledge on 15th November 2014, sold it on 20th November 2014 - and guess what! He still hasnt refunded my money and responded to any of my messages and voicemails left on his home number, which I have consistently called almost everyday for last 2 weeks of November 2014!

Warning to all sellers, if there's something wrong with an item that he sold to you, he WONT refund the money to you even if you return the items. He will make up some excuse and ignore you totally.

You allowed this to happen. If you had opened a Paypal dispute you would have been given an address to send the return to, without that even if you were within the time frame to open a dispute after you had returned it all the seller had to do is give a different address for the return and you would have been suffed like the Christmas turkey.

Your only hope mow id if you funded the payment with a credit card and have proof of delivery of the return you could ask your bank to do a chargeback.

I know it was my mistake to not go with the PayPal address, instead I used the address provided on the return to address 'address'.

I just called them again like last night AEST 18:26 - the exchanged contact number as provided by EBAY - again leaving a message, a name not recognisable to the sellers' name provided by EBAY (dee and sam - **bleep** is that)

This is a warning to d***d who had bought this card on 20th November 2014 to beware.

The card is damaged on the middle bottom edge due to possibly the hard case holders' screws have been forced on to it.

If anyone knows a friend or a friends' friend who recently purchased this card from a US seller or simply the buyer itself is from the US, please be mindful.

EBAY is investigating this seller - another strike will hopefully bring this d*** down!

I guess it's too late now (just) to leave negative feedback. You could try, but unless the item was delivered within 4 days of you purchasing it, you would be too late now, Shame, because that could have upset the apple cart a bit more for him.

Remember in future, NEVER EVER send something back without opening a dispute. I see too often on here people doing that and then coming in her complaining the seller didn't refund them. A costly exercise.

The seller only has 2 neutrals and both from the same buyer, and it sounds like it was for the GSP.
