Scammed for $3000 - eBay is refusing to refund.

Hello,

I bought an RTX 4090 brand new for $3000 AUD and the seller sent a fake tracking number.  Just a day before ebay was due to help, he added a tracking number that showed it was already delivered 3 days ago, but nothing ever arrived. My mum went to the post office and checked with them. and the new tracking number was an envelope when the item is 3kg+ and judging by the feedback a second victom gave, it probably wasn't even shipped to my address. eBay is refusing to help even with it being an obvious scam.

First though ask them if they saw/read/understood the screenshot of the message AusPost sent you.

Whether they - saw - read - understood - is not the issue - being asked to lie on a legal document is.

Yes, but they handle cases very sloppily sometimes (sometimes? well...). Maybe they didn't even look at the screenshot or just quickly read it was an envelope, and if they don't even realize what happened they didn't really ask the OP to lie.

Followed by a Stat Dec saying ........................received an empty box or whatever.

The OP has stated a parcel was shown delivered - but not to her address - nothing has been received at her address.

They've understood nothing.

Yes, that's the issue. They haven't read properly and haven't understood properly, trying to close the case ASAP.

I'd be tempted to email them thanking them for their concern - and that - I was adding the Stat Dec to the Police Report.

eBay has now closed my case, because they were notified of the successful bank chargeback. Guess I have to wait about 1 more month to see if this will finally be over.

Small update:

Still fighting with the bank, eBay has provided magical evidence, that I cannot see yet.

See attached what the seller has wrote about me and other buyers, I am absolutely disgusted.

That is horrible. You can contact eBay via live chat to have it removed, as foul language is not allowed in fb, and the seller will most probably also be suspended.
