Seller doing the dodgy on me

I bought an item a couple of weeks ago, and when it hadn't arrived or marked as posted 7 days later, I contacted the buyer asking if it had been sent. Seller said it had
I received the item today and it is postal marked as being sent the day after I contacted her.
Postage was also outrageous, she charged $4.50 and postage was $1.20. I didn't question it at the time of purchase because it is a breakable item and I thought it may have been well packaged. Not so.
In the end I have left her neutral feedback (in reality it probably should have been negative but I believe I may need to take some blame)
She has left feedback for me saying that she refunded the money due to it being 'lost in the mail' which it wasn't and that I should be made to pay registered for purchases.
I have now noticed that she has placed a bid on one of my items, which I find strange given that they are old train magazines, and she only bid on one, and the lowest priced one.
I sent her an email, asking why she stated that refunded me when she did not, and asked her whether she has bid on my item for payback.
She has responded to my email simply with a 'boohoo'
I've sent the email to ebay but how can I stop her bidding on my item and leaving me bad feedback?
Can I get her feedback she left for me as being her buyer removed? How?

FYI, she is now sent me emails stating that she will bid on my items and leave neg feedback or she will get her friends to.  She is also going to report me for having a fake address, which I don't, and she is going to tell my neighbours that I'm a creep.


She also asked whether all of her lovely freinds in the discussion boards helped me or not.


She is also harassing me through my Paypal private email address.  She is reporting me to the ATO..............I could go on



 


Keep all correspondence and report it to police, she has committed, at the very least, 2 criminal offences.


 


- Using a carriage service to harass or menace (Commonwealth offence)


- Unlawful stalking (or the equivalent in NSW)


 


Both offences carry potential jail time. Don't let this slimeball get away with it, god knows how many other buyers she has done it to as well. Might be worth contacting anyone who left a neut or neg and seeing if they copped anything similar and encourage them to go to the police.

Wardy is spot on with the crimminal codes this freakout has broken and I for one wouldn't hold back from having it dealt with by the police.


Stalking electronic means is a criminal offense in Australia, and that's exactly what this fool is pulling, stalking with menace

 I'm well aware that I should have questioned what the postage and packaging would have been prior to bidding.



 


No, you do not have to question postage  when the cost is quoeted.  You have a right to assume that seller will post safe way, and that the charge quoted reflects the actual cost of posting.  $3 for wrapping and handling is way over the top; I do hope you gave her just 1* for that.

Thanks for your responses guys.


the emails to my personal email address are still coming.  I've kept them and will hand it over to police.


Apparently she's been busy checking whether I have an ABN number or registered business this morning.

I would not be worried about the ATO. Just be sure you have all your paperwork in order. The ATO can be pretty fair so long as they can see you have been trying.

She obviously doesn't know that if you trade under just your own legal name you don't need to registar the business unless you chose to, and getting an ABN is the easiest thing in the world to do under your own name as long as it's for real business reasons, costs you nothing.


 


She's either as mad as a hatter or plain deranged (Yeh, I know, same thing) lol.


That's one Ebay seller Ebay could well do without!

I believe whatever postage you are prepared to pay and pay for it, then you accept that is the cost regardless of the actual cost was.


 


Maybe you also havent included ebay fees, fuel, labour, time etc, i dont think she profited much given if the item was purchased really cheap too, maybe even below cost.

The item looks pretty straight forward. You described it as breakable which it does not look like it is. How was it sent?. And what did you receive instead of what was pictured? 🙂
