Seller listing when no product in stock!!

I find it very frustrating, I pay money for an item only to discover seller doesn't have product in stock & then have to wait 11 days to get same??
Sellers should not be able to list if they don't have item in stock..
It has happened twice with one particular seller, I think I will buy these elsewhere from now on!!

it depends, was the item listed as not being in stock, or was it listed as though the seller was in possession of the item already ?
if they are selling stock they do not have they should advise of that in their ebay page, otherwise i consider that a type of misleading advertisement
personally i wont buy from a seller who does not carry the stock themselves

If they're out of stock, there is a reasonable chance they knew it, and left the listing running to avoid losing the sales history for rankings in 'best' match. Smart sellers just jack the price up so nobody will buy. In this case, if this is the reason, they are engaging in deceptive practices. Besides if the item location is stated as their normal storage location, and it's not there, then it's item location misrepresentation.

I couldn't care less so long as I get it within a reasonable time frame.
If I want it urgently and it's out of stock I would politely request a refund (and would expect the seller to comply).

Personally I think If you don't have the item in stock, then you don't list the item until it is in stock.
I din't know the item wasn't in stock until I emailed 7 days later, that's when I was informed he had to buy new stock!!

I receive items quicker from the UK than I do in Australia, that's on ebay!!

I wish sellers were more truthful about this. A seller who specifies they have 6 or 20 or whatever number of items available for sale then it turns out that they have none is being dishonest IMO and should refund the buyer.
Some items I am interested in are sold on pre order - I don't think there is anything wrong with that as long as the seller specifies it in the listing.

If a seller tells me an item is out of stock and gives me the option of waiting a few days or getting a refund then I am fine with that. If they say nothing but the item takes more than 3 weeks domestic or 4 weeks from overseas I open an item not received dispute. If they provide tracking that shows it was posted late then their postage delivery star will be trashed.
It says in this book I am reading that by 2065 80% of women will be overweight.
See what a trendsetter I am?

Having read this, now I do agree that the seller is at fault. You most certainly should have been informed the minute the seller was aware of the item not being available.
Remember also in my original reply I was giving the seller the benefit of the doubt as to not so much listing an item not knowingly available, but perhaps losing track of stock on hand. In your above clarification Michelle, I think the seller has done the wrong thing by you.
You can't please all the people all the time, so now I just please myself

I list items that I don't have in stock but I always make a note in BIG letters at the top of the listing on when I am due for the shipment, and if they wish to pre order they can or simply wait until I have stock and then buy it. Quite simple really.

I assume you list the actual source of the stock you don't have. ie China vs Sydney or Melbourne or wherever you live. What is your ratio of items in stock vis a vis those you are currently out of stock of? Do you understand the term dropshipper?
Item location is the location of the item, not where you would like it to be in an ideal (unrealistic) world.
Do the items with the BIG letters state in stock? No? Why would anybody pre-order with the attendant hassles pertaining thereto?
