Hi,
I am after some advice on how to proceed against a seller on eBay. The amount for claim is small, but I am trying to get the product removed from the market for safety reasons. ACCC requires the ABN/ACN which eBay refuses to provide for "privacy" reasons.
Any idea how to proceed?
Thank you.

Everything, well almost, is made in China lol This product is sold in Australia by an Australian reseller. You may find this hilarious. I think it is dangerous for pets and children and shouldn’t be allowed to be sold in Australia. Simple really. Will post their reply whenever we hear back. I’ve bought around 8 playpens from Pawz and they’re excellent. Again, all made in China.

To be quite honest - these ' play pens ' - at most - 80 cms wide - with the given heights - suggests puppies - not dogs.
Especially a dog of the size you have shown.
Don't bring children into the discussion - the ' pens ' are certainly not fit for this purpose.
As for involving a lawyer - well.........................??...........................what's his/her case - the pen - the dog - both.
Sounds as if this is a money making adventure - having purchased at least 8 - I hope you have the requirements & insurance.

No money involved as this is foster caring. I’ve checked with council, no license required either. I am NOT seeking any refund let alone compensation.
Anyway, thank you all again for those that provided help. The rest can laugh and go their merry way 🙂

They mention bar spacing once. I am not sure if it is the same for all cages.
What they should do is add a warning that a dog's paw could get trapped between the bars and that the bar spacing might not be suitable for all dogs or pets.
The Taily dog playpen is Ideal for various pets including dogs, puppies, kittens, guinea pigs and rabbits etc.
Maybe they should change this to "small pets"?

Who's laughing - a dog was - hurt - injured - in your care.
You do not need a lawyer to submit a ' report ' to ACCC - but you do need facts.
And those facts will not stack up - simply because the pen was not fit for purpose - not that it is a danger.

Somehow this is not stacking up - quote : The amount for claim is small - from the OP.??

So why is your link now dead, hope a copy was not forwarded to Mr Ko Gan.
You really need to understand your legal obligations, before posting on public forums

@nivi_k wrote:Thank you again everyone for your time. This is not about a refund! It could have just as easily been a child getting her hand stuck between the panels. I am just relieved that we were home when it happened as the pain would have been excruciating for the few moments that her paw was stuck in between the panels.
As for the comment about playing with fire, really? My conscience won't let me turn a blind eye, as simple as that. I would never, ever want to see another dog get injured or a child for that matter. Anyway, I'm letting my lawyer handle the matter.
Kind regards,
N
Make sure you advise your lawyer of your defamatory post, as per your now dead link. Not a good idea to implicate a very large company, when they were in no way party to your purchase.

OK, now I'm concerned. Are you caging up animals or children? Do you have photos of the caged children, like the ones you linked to of what appeared to be a very happy dog? If you are caging up children, then there are laws against that and I think reporting to the ACCC is the least of your problems. I still want to see photos of caged children.
If you bought 8 cages from a seller that were to your expectation, then why did you then buy cages to contain children from a different seller? Makes zero sense to me.
