The Resolution Centre is a dead-end. Can any one help me?

On 4 November I ordered a Paslode nail gun on eBay Australia. The seller is located in Australia and I am located in Australia.

 

On Monday 10th November I was checking the progress of my purchase and found it had disappeared completely from eBay and MyEbay. I logged out, logged back in, still couldn’t see the item. I suspected a possible glitch but was really worried I’d been ripped off somehow.

 

Since I couldn’t raise an issue on eBay (as the item wasn’t there) I raised a claim with PayPal. The only option available for me on PayPal was “item not received”

 

On Tuesday 11th November I again checked my eBay account and found to my surprise that the item had been reinstated – all the transaction data was back in My Ebay.

 

I assumed the earlier day’s problem had been an eBay glitch, and fearing I may have unnecessarily upset the seller, I immediately withdrew my claim PP-003-523-402-584. I also sent the seller the following message via eBay: “Hi xxxx, there was some kind of problem with eBay last night and our transaction completely disappeared from eBay for some hours. This led me to make a dispute with Paypal as I couldn't work out what was going on. I've since seen the transaction is back on-line, so I cancelled the Paypal dispute. Can you tell me when the framing nailer will be shipped? sorry for any inconvenience”

 

I got no response so sent another eBay message on 12th November – “Hi, Can you please tell me when this item will ship?”

 

I got no response so sent another eBay message on 13th November. I again received no response.

 

I have had NO responses from the seller to any enquiry I have made.

 

I became fearful I was being scammed and tried to cancel the purchase through eBay but was not allowed because of the earlier “resolved” PP dispute. So I went to PP to try and re-lodge my complaint for failure to deliver/receive however I was again prevented from do so, again presumably because of the earlier “resolved” case. With no other option available to me to bring this their attention, I raised an unauthorised transaction dispute on 16th November and provided details of my concern.

 

It appears from the PP resolution centre that PP has tried to contact the seller numerous times over both disputes raised and received no response, and subsequently closed the case. I then called PayPal and spent about 30 minutes on the phone to be told that they couldn’t verify the transaction was fraudulent, and that since I’d had and “resolved” one non-delivery claim, I couldn’t make another claim for that same item.

 

I still don’t have my Paslode Framing nailer, the Seller has still never replied to any of my or your emails, and the seller still has my $400.00 None of the eBay Contact Us options I’ve found allow me to get to a resolution.

 

Please help me. What can I do?

 

When I purchased seller had 0 feedback. He now has -3. Please also be aware that this seller tbakhour has apparently also sold another 16 of these items, so there are going to be more problems.

sorry to say but I think you can kiss that money good bye. 0 feedback and selling $400 nail guns should have been a HUGE red flag.

A word of advice. Do not purchase expensive items from ebay unless you are willing to lose the money. You are far better spending the extra money and buying from a retail shop where you get after sales service and warranties should anything happen.

This guy has sold 17 on them and the carnage is only now starting to fallout. eBay and worse, the guy on the phone from PayPal don't appear to give a damn that there is a scammer on the loose.

I don't think I would take this one lying down. I would call paypal & ebay again & again if necessary and find out what is going on. It's all documented. Ask to speak to a Supervisor and just keep following it up. If you don't get a satisfactory answer / judgement, I would then proceded to the Ombudsman. This seems to be out of control and across the board.

As far as I understand it you can either open a Paypal dispute or an ebay dispute, you cannot change your mind and jump ship half way through the voyage. Once you closed the Paypal dispute it was done and dusted. While there may be some advantage to using the ebay process for a not as described item regarding return postage cost for not received Paypal is just as good so why on earth did you change?

 

Your only hope now is if you funded the payment with a credit or Visa debit card you can ask your bank about a chargeback. You can try calling Paypal and explain what happened and ask if they will reopen the case but I don't hold out much hope for you.

 

The ombudsman can help when Paypal or ebay policies have not been followed but that would not appear to be the case here.

If eBay is withholding the funds until delivery has been proved, the scammer won't have the money. Therefore, I don't understand why Paypal don't just reinstate the claim and refund the OP's payment. If they still refuse, who gets to keep the money that Paypal are holding? Surely they don't believe they have the right to keep it, do they? What Paypal are doing is tantamount to theft. Absolutely a case for the Ombudsman IMO.

paypal couldn't get hold of the seller, the buyer said. Did they try hard enough ? Did they look into the procedings. who knows ???

Thanks for all the input. Can anyone give me a sure fire way of getting to speak with someone at eBay? 

 

All the Resolutions centre options inluding "other" do not even give the opportunity to contatc by email, let alone phone!

Why shop locally and pay damn exorbitant high prices when you can buy things so cheap on ebay, and also items you cant buy, and would never find in Australia anywhere. To say "oh just walk into such and such a shop and they'll stock it" is laughable.
