Assuming it's an eBay purchase, paid for with PayPal, if it hasn't arrived by day 40 from purchase (not payment), open an item not received dispute through PayPal. That gives you an extra 20 days for it to arrive and still be protected. You can then escalate the dispute to a claim if it doesn't arrive and PayPal will return your money.
If by some chance it does arrive after you have been refunded, you can either send it back return to sender, or repay the seller. You only have 45 days from purchase date to open a dispute, but most people suggest opening it on day 40. If you don't open a dispute and your seller goes quiet, you will lose your money.
To open the dispute, go to the item in your purchase history and in the dropdown at the right, select "I didn't receive it" and then follow the prompts. If you have contacted your seller, don't let them string you along by asking you to wait a bit longer. Day 40, open, regardless of how much they beg.
