So I just bought a pair of gumboots advertised as follows, (cut & paste wording)
BUT they are NOT EVEN CLOSE to that description, they're a cheap, ill fitting, poorly constructed boot that would last 12 months, I'm a 60+ yo farmer, 6th generation so I reckon I know gumboots as I've worn then since I could walk. So I know what I should have got based on the description and I understand consumer law SO WHY THE BLOODY HELL DOESN'T EBAY??? How do we stop this from continuing?

I used the title to look up these gumboots, after reading one of the other replies and if it is the ad I think it is, they cost you $12.99.
One thing is clear though-ebay does not examine the products that are being sold. If they are given details about a clearly fraudulent listing, it will be pulled down.
So is this a fraudulent listing? It uses the words quality and heavy duty. Those aren't legal gradings as far as I know. They are subjective words. All sellers are going to talk up their products and say they are good quality, that goes with the terrritory.
You say you are a farmer and the boots would only last 12 months. Could ebay really decide that wasn't heavy duty enough under that sort of use, where presumably you would use them most of the year?
If they fall apart on their first wear, you could make an ebay claim for not as described but I think most places would say 12 months was fair wear and tear.
From what i can see, you did buy from an Australian based seller, but let's look at your other complaints
cheap-yes, $12.99 isn't a lot to pay if you expect years of wear
ill fitting-feet differ, Even a good quality brand of shoe can hurt. It's a risk buying online without having tried a shoe on.
poorly constructed-possibly but if you think they will stand up to 12 months use that isn't too bad.
Bottom line: As a farmer, you probably know the genuine high quality brands of gum boots that are comfortable for you, that are well made and will give years of service. Stick to them. That company may even sell them online or on ebay, but don't go buying cheap on vague terms such as 'quality'.
I am not sure what you expect ebay to do. You bought a pair of gumboots, you got a pair of gumboots. They don't fit properly. The ad I saw offers a 30 day refund with buyer to pay return postage. Go for it. Or if you live near Epping in Vic, you can probably return them in person as it says pick up available etc.

Yes, it is such a waste of time and lots of stress especially navigating for a refund. These sellers will do anything to get a sale. It is always wise to ask seller lots of questions first and then check around for the same item you want to buy. At times it is easier to buy/order from a shop (if possible) even though it may cost an extra few dollars. I've been caught out in what is clearly false advertising and was sent a different item from a reputable company (drop shipping). I will report this seller as they've done this to another buyer.....Ebay needs to update their policy regarding false advertising (and drop shipping). Report unruly sellers to Ebay!

Also open the appropriate disputes within the time limits and follow through with them
and leave the dodgey sellers neg feedback
