I paid for and "purchased" an item before 5.30am. I got a message just under an hour later saying thank you.
More than FIVE hours later, I got a message saying the item is not available and saying they would help me to cancel.
This is unacceptable as it seems the item either did not exist or did but was sold to someone else AFTER I paid. (there has been no contact by the seller since to say what happened or on anything) and since the item is a battery charger and I had already purchased a battery elsewhere, I will not be able to use the battery now (and I would have gone elsewhere).
I am NOT going to request to cancel on principal
The money should have been refunded immediately to my account as cash so I could use it again.
I want to bring this up with Ebay (for them to examine if the same item WAS sold to someone else AFTER I paid.
This is not huge money but I am more likely going to have to consider it as theft.
I guess there is no way to contact Ebay over this yet?

It's not silly behavior. It's a forum where people come to vent their frustration, quite often when emotions are running high. It helps them to talk it out. Their 'behavior' doesn't have to be perfect. Pot kettle there
Very good point 11dustyattic and about time someone mentioned this again! This is after all this is "the buying" forum. People should get some emotional support or be allowed to vent frustration without condemnation, attacks or being mocked. Sadly some folks think they own the forum.

Yes, of course the buyer can accept or decline a cancellation, but they can't initiate it, which is what Springy was implying. She's been around long enough to know that.

Returning once more to my analogy with a child, the type of support typically offered for this kind of tantrum would be an afternoon nap or a diaper change.

In this case, you have the right to do absolutely nothing. There is no onus on you to cancel. This will make the seller either cancel himself & refund or lay himself open to an item not received claim.
Geez Springy, I thought you'd been around long enough to know that a buyer CAN'T cancel. Only the seller can cancel. Therefore, the seller can't "fly under the radar" because they are the only one that can cancel. If the seller chooses to do nothing, then that's their problem, but even if the OP wanted to, they can't cancel the transaction.
I think you have misconstrued my meaning and it is true, I could have worded it better. Much better.
I know only a seller can cancel. What I meant was the reason given for a cancellation. The Seller wants to pass this off as a buyer requesting cancellation, rather than a seller cancellation. He wants the buyer to ask for a cancellation. That is how I interpreted it.
As you say, there is nothing to stop the seller cancelling it himself & refunding the money, but he hasn't done that, has he! Nope, he is telling the buyer they will need to request a cancellation.

There's nothing from the OP that indicated a need for an afternoon nap or diaper change. Yes, upset and maybe letting the issue get to them but quite right to speak out about it. Actually there's a need for these types of post as it keeps us up to speed about what's going on and how many people are dealing with cancelled sales / withdrawn orders. Often these are done with out explanation. Actually, I'll change that to sometimes as the explanation may be right or it may be false / incorrect.
I'm not so much defending the OP here as I'm more speaking out, defending the right for people to speak out about things that are unfair or upsetting to them. I'm also speaking out against that certain culture that has existed here for some time.
