complaint about a seller

Complaint about <Removed> seller--BEWARE of this seller--On 10/10/2010 I purchased a brushcutter from this seller. Unknown to me at the time was the fact that this seller was selling goods on EBay which they did not have in stock!  After waiting 3-4 weeks after paying for the brushcutter, they finally answered my emails and advised that they were awaiting stock. I then made a complaint to EBay about this buyer selling goods which they did not have and after investigation by EBay, my brushcutter finally arrived some 6 weeks after my purchase.  <Removed> did send me a $25 cheque "in consideration of the delay with your brushcutter" I was happy with the brushcutter.  Recently, the pull starter on the brushcutter broke and I then contacted <Removed> through EBay for a replacement pull starter assembly, on the 9/6/2014.  Before they would assist me , they requested that I provide them with--1) date of purchase, 2) full delivery name, 3) full delivery address, 4)EBay user name, and 5) telephone number. I provided all the requested information on 10/6/2014, as well as a photo of the pull starter assembly. <Removed>then started "playing games with me, stating that they never recieved the photo, even though it was attached to my email to them. I resent the photo to them another 2 times. They replied that they had forwarded the matter onto their spare parts section and were awaiting a reply. On 12/6/2014 I again emailed <Removed> requesting a reply, however they have ignored my email to date.  I feel that <Removed>have "played games" with me as I put in a complaint about them 4 years ago!!!  I find their behaviour very unethical and just plain childish.  EBay does not need these types of sellers and they are hurting the reputation of EBay. Could you please look into this matter. Thanking you, Graham Carpenter.

Graham, you are not talking to ebay here. This is a members forum, not a direct line to Ebay administration.

There are no warranties on ebay items unless the seller is a authorised seller of the product.

Let me get this straight.

You bought a brushcutter back in 2010 and were stuffed around by the seller.

However in the end the seller did come through with the brushcutter and sent it to you PLUS a cheque for $25 for all the bother they'd caused you. (to be honest even if it was a pain to wait so long at least you did get your item as well as the cheque they sent to you in good faith.)

Now 4 years later the brushcutter breaks.

As far as I know brush cutters have a warranty of only 1 or 2 years, so the fact yours has lasted 4 years almost is pretty good considering.

Why is the onus on the seller to replace the broken mechanism?

And am I correct in thinking that you want that replacement part to be supplied to you for free?

Why don't you just go to a bricks and mortar store and buy the part from there?

I can't see why the seller should send you a replacement part.

Also: you aren't supposed to name and shame on these boards.

you are expecting too much. I wouldn't even expect that from a bricks and mortar shop

In the words of the infamous John McEnroe "You cannot be serious!"

You are still whinging about an issue from 4yrs ago & you are still annoying that seller for free spare parts on a 4yr old brush cutter.

I see in your feedback left for others that you don't mind a bit of a whinge & sellers give you replacements.i think it's about time that you learned that there is a limit.

Leave the brushcutter seller alone & go to a hardware store to buy the parts as no-one is obliged to replace parts for free for the lifetime of an item.

Seller playing games with you indeed ,it's so long ago that the don't remember you or the transaction but you do have a hide expecting so much.

You really do need to find some better way to occuoy your time and your brain. To still be investing time and angst about something that happened 4 years ago is doing nothing except allowing a perhaps shonky seller to go on torturng you. To me it is almost bordering on obsession and you perhaps need to get some help.

I can't for the life of me understand why you would think that a seller would replace a part that 'fails' after close on 4 years!

I notice in your feedback left for others that you recently bought a brushcutter.  I hope you do not hold that seller to a four years parts replacement.

Please do me a favour, never buy anything from me!

complaint about a seller

Hi, thanks for your comments and a wish to advise--1)  yes, I did think that I was writing a complaint to EBay,   2) The seller was selling goods that they did not have in stock at the time of listing  those goods for sale and this is highly unethical and most likely not permitted by EBay,   3) at no time did I request  the required part under warranty, I enquired if they could supply the part and at what cost to me--I wanted to BUY the part and the seller was NOT under any onus to supply me with a part, however, they were under an onus to act in a professional manner and advise me if they could provide the part and as to the cost of that part !  It is common courtesy and good business practice. I am still awaiting an anwser to my initial enquiry!  4)  I live over  40klm  from the nearest town and over 100klm to the nearest large town, and yes, I did try to purchase the part from several mower shops first, however, as it was a "Chinese" made brushcutter, they did not and could not source that part for me. Going back to the original seller of the brushcutter was NOT my first or preferred choice. Still It's disappointing that you have made some negative comments and you are not correct in your assumptions. I am sorry that I posted my complaint on a "forum"--that was not my intent, it was my inexperience with EBays' systems. Graham.

Hi, thanks for your comment and wish to advise that I thought that I was making a complaint to EBay (my lack of experience with EBay systems) and that I enquired from the seller as to the availability of the part and also the COST of the part. At no stage did I request or expect the part to be supplied under warranty.  That was an incorrect assumption made by grumpy*cat*rocks, along with several other incorrect assumtions that he/she made. Regards Graham.
