On the weekend I bought an iphone from a seller.. (estimated arrival from today - monday)
since then I have sent 3 emails and no reply
tried to phone them but number went through three different dial tones then disconnected
Saw the seller has listed the item agai,same photo, same description.
I have rung ebay to alert them and the suggest that I wait until sunday for a reply from the seller before opening a dispute on pay pal.
My question is though how soon do I give it up as gone and get another - I;m leaving oz for an overseas trip on two weeks and really need a phone.
does anone have any thoughts on this?

The phone's been sold 5 times.
I suggest you log on to Paypal and file a dispute immediately.
Escalate to a claim as soon as the system allows

As the phone is only coming from Victoria I would open INR now and escalate to a claim if you don't receive the phone by next Monday (a week after the date due).
You will receive a refund from paypal if the seller can not provide proof of postage.
It is a very new seller, so i would act now rather than later.

You haven't even allowed enough time for it to arrive yet. eBay's estimate is 1-6 business days, Australia Post's has been 2-7 (even around the corner) for about a year. If they posted on Monday, you can't have a real expectation of delivery before Wednesday next week. Buy one from a shop. Those ones even have a warranty that is valid.
