I bought a lens from an established EBay store [oz.online2] and had to return it for warranty repair almost immediately to HK. They have had it now for something like 70 days. Messages went back and forward between us for the first 6 weeks, none satisfactory as to why a promised 10 day service time now has become a desperate attempt just to get back my item. Now it has got to the point where they do not answer my queries at all. Ebay was helpful at first but achieved nothing and are now advising me to spend another $1000 and buy the lens again!!
Am I just expected to accept that this item has gone forever? - and the seller is still acceptable to EBay to continue trading?
Shouldn't EBay have some mechanism for dishonesty and perhaps [hopefully not] outright theft? Has anyone else had problems with this seller?
What do I do now? I can't, of course, find any details about who actually owns and runs this seller.

No you cannot expect ebay to help you, if it went wrong within the 1st 45 days you should have gone through a Paypal dispute for a refund, if I bought anything of that value then I would have funded the payment with a credit card so I could do a bank chargeback.
What you should never do is rely on any seller, especially an overseas one, offering a warranty, it is very difficult to enforce one even with an Australian registered business.
Sorry but unless you used a credit card and you are still within your bank's claim period and can try them as long as you sent it back with tracking then you have lost your money.

Its not up to ebay to monitor EVERY seller using Ebay AU.
Did you bother to read your sellers feedback before purchasing your lense, ( to which you left positive feedback for on the 21st December 2012 i might add! )
If you had known of his already 23 Negs and 18 Neutrals for the past 6mths, and the prices of those items are in the hundreds of dollars each.... personally,cant blame ebay on this one.
Also, he is located in Hong Kong, so its not really Ebay Au fault you purchased from him.
If you had any knowledge of the buying policies, you could have followed the correct proceedure for making a claim against a faulty item, and this transaction could have gone a lot more smoother for you.
please dont just jump to blame ebay when things go wrong.

You are at fault mal. Always open a Paypal dispute within a few weeks - 45 days after you paid is the time limit and stop donating your money to rip off artists.

Hi 707Mal,
Since making this post have you had any response from the seller/repairer?
I am having a similar problem with the same seller, over a mobile phone.
I am now getting worried as they have stopped all communications with me.
It has been a two months and the phone only stopped working after the 45 day period.
I am pushing the for a response with no luck so far.

It's better to start a new thread Vicky - you have revived a dead thread.
Because it's past the time limit to open a Paypal dispute they can't help you. If your payment was funded by a credit card ask your provider to arrange a chargeback. Apart from that it looks like you may never hear from the seller again. Next time you want to buy a phone consider buying one from a store. You will receive a manufacturers warranty that the company will honour.
