I bought an item covered by eBay Money Back Guarantee.
Item was expected to arrive on 26 Nov.
Waited until 11 Dec to give it a fair chance to arrive an open a case with customer service.
Seller responded today (16 Dec) saying he can see some movement in the tracking.
eBay suspended the case for 10 days and refuse to refund.

I was chatting to a supervisor to no avail. He went through all his conversation cards but it felt he has no authority to take any action.

No it's not a scam, BUT you need to keep an eye on the dispute and escalate it as soon as you can, otherwise it will time-out.

According to Aftab from customer service while there is a "movement" in the tracking they won't refund me.
And so, with some "movement" the item can be 3 month delay and still no refund. What is actually guarantied by eBay Money Back Guarantee?

An item not received dispute is something the buyer opens themselves
You say you opened a 'case' with customer service
So did you actually open a dispute or did you just contact eBay and told them it had not arrived?
And usually if the seller is unable to provide valid tracking, they don't get a say
If the item was due to arrive by the 26th November, and you opted to allow another 2 weeks, it seems highly unlikely it was posted on time
Where was the item coming from?
Where is the seller registered?

Was the item being sent from overseas?
Did you pay with an eligible payment method, or did you pay via bank transfer directly to the seller?

Yes, opened a dispute.
Yes, has tracking. but tracking was stagnate for 2 weeks and they just update it so it seems it keeps moving.
Agree, highly unlikely posted on time.
Suppose to come from Australia.

The point is I bought an item on eBay from a Top Rated Seller and the order was confirmed with expected ETA up to Nov 26. Now is Dec 16 item has not arrived. Should I get my money back?
