I purchased a phone in Dec 2013 returned it on Jan 2014, <removed> have not replaced the phone and now refuse to reply to my message requests. Ebay have frozen their account as their contact details are in correct, this is not an Australian business it is based in Malaysia, very bad experience

Your question has nothing to do with this thread....you should start your own thread to ask your question.
But to answer you quickly.....you go to the Resolution Centre in ebay or paypal to open a dispute.
If it is an item not received dispute use paypal. If it is not as described it is better to use ebay.

Contact Department of consumer affairs in NSW on 133220, and explain your case, be sure to send your item back with complete tracking so you can verfiy its been returned, there items are been dispatched from NSW Australia, So they have to follow Australian laws, not there own country, also the ACCC have been noitfied also, good luck everyone
