Your post doesn't make sense, why would the seller want a refund from you?
You don't appear to be a seller yourself, so I don't understand if you meant "buyer" not "seller" in your post.

Guessing you mean the seller wont refund?
If yes then once the date has passed for the delivery estimated by ebay you can open a dispute for item not received.
You can then escalate to a claim as soon as the system allows and leave feedback to reflect the transaction that is is factual and not rude.
