@lyndal1838 wrote:If the seller was in another state you will have to contact the Fair Trading Department in that state, but that will not do you any good if it was a private seller. You still have not specified if it was a business seller or private.
You can lodge a civil dispute for hearing by a State civil tribunal for hearing regardless of whether a trader is a private seller or a business.
For example, from VCAT website on civil disputes: "It does not matter if the party is a consumer, trader, company, business, individual or if the goods and services were for private or business use."
You can also still seek information from your own State's fair trading department on what may be involved in the process of managing an inter-state dispute.

Than k you all,I don't argue I haven't been foolish & I am certainly not blowing off steam at being ripped off! However, can someone please explain how this situation of being blatently ripped off is ignored by Ebay & not worthy of investigation by Ebay. while all others are?If I bought a book for $10 & it had a torn page, it would be investigated & possibly the sale cancelled & my money refunded if I complained. The same would apply to an Elephant,an Aeroplane,or a rare antique etc etc. It is all to do with the description of the item by the Seller that we decide to buy & the price we think it is worth based on that description. At least 99% of people buy unseen purelly based on description! If I complain it is Not As Described my complaint is investigated & a judgement is made. Now here we have a car, bought unseen because it was 3000klms away & the buyer could not travel to inspect it,however it had a good report on its condition by the seller, great mech cond, drives like a dream, gleaming Burgundy paint etc.Sounds great, but still wary as you cannot be there to veryfy it,you ask more detailed questions about the car & the answers are reassuring.Based on all this you bid accordingly, just as anyone else would do on a different item. The item arrives & it is a total wreck! It won;t start, the shock's are so dangerously worn it cannot be driven, the paint is allready flaking & falling off etc etc The seller is a fraud & I am the Idiot! But am i any different than all the other millions who bought on E-Bay who cannot inspect the goods & rely on the Sellers description to be accurate? Why should Ebay turn a blind eye to all of these fraudsters who are ripping off millions of innocent people who thought that they would have some protection from Ebay just as everybody else have when buying their Elephant or Aeroplane or Antique!! It is a situation where Ebay invites Fraudsters & Conmen with a Get Out Of Card Free to do what ever they like with as many lies as they like to make without any consequences How fair is that?

I would never buy a car online. If it wasn't in my comfortable travel radius, I wouldn't even consider it.
How do you suggest eBay determine if a car is not as described? With most items there are visual cues. Except aircraft and I think you'll find they're not covered either.
How much does the Red Book say your Merc is worth? it might be worth fixing.

They depend on the buyers description in most cases, however in cases like these they could simply ask you to provide an independant authority like NRMA or RACQ report to be provided & if it differed substantially to that provided by the seller it would be proof,if it didn't differ too much -no case!

But why did you not arrange for an independent inspection before buying?
Surely you can see the difference between buying a car and an expensive collectable on ebay?
With a collectable you can see at a glance if it is not as described. You open a dispute, escalate to a claim and if you win the dispute you send it back and get your refund.
You are asking for trouble if you just take the word of the seller about the condition of a car. That is why you are supposed to inspect it before parting with any money.

Red Book?
Not harping, but the perceived value could well have an impact on any remedies available to you.
eg If you pay $10k and it costs $6k to fix and it is then worth more than $16k, you might be hard pressed to get any remedy, as you would not have suffered any loss.

OK, I think I read somewhere that motor vehicles don't get eBay Buyer Protection, but that may have just been for PayPal.
BUT, assuming that you can for a minute or so (I'll have a better search around in a sec)
I am thinking that it may have something to do with the timeline.
When did you try to report the seller to eBay, or attempt to go through the resolution centre?
ie how many days after purchase did you try to do the above?

I dont understand the difference? You don't ask for an independant inspection of your collectable before you have bought it ! You have depended on the sellers description to be accurate. What is the difference between what I bought & the Collectable.NONE! Both should have the same protection against fraudulant desciption, otherwise it invites con men & crooks to sell inferior goods knowing they can get away with it.Are you willing to agree to that ?

OK - here we go
THERE IS NO EBAY BUYER PROTECTION ON ANY PRODUCT LISTED ON THE AUSTRALIAN SITE!
ATM, eBay only offer Buyer Protection on items listed on

At a minimum, if a safe trading place is important to you, why have you not left feedback for the seller involved ?
