with Ebay or paypal requiring proof of items being sent so you can get a refund, what proof does the seller have to give if i put in a item not recieved so i can get a refund that way?

A strange question for a buyer to ask, but here we go - the seller needs to show the click and send lodgement receipt, or insurance/tracking receipt and this will prove the item was sent. Whether the item arrived or not is not relevant as the seller has only to prove postage to your address.
Before you open a dispute, have you contacted the seller? How long overdue is the item? Please give the seller a chance to locate the item, but of course keep an eye on the dates so you don't run out of time to claim.

Do you mean that you have received the item and it is not as described so you want to know if you would be able to win an item not received dispute if you opened one?
If so not very clever coming on the boards to confirm if you can make a fraudulent claim!
The seller's proof is exactly the same as that you would have to provide if you returned it. Reg post, click & send, eparcel, express parcel (not satchel) or platinum express.

That's why you open a dispute with Paypal and return it by trackable means to the address Paypal provide, when they provide it.
