i won an auction on the 28th..i paid straight away after by paypal...i have sent multiple emails regarding my purchase..seller has not emailed me at all...he has my money but will not contact me...how come a buyer can be banned for not paying in the first few days but a seller can take your money and ignore you and not send the product

Yes. So why did you have to know from him, if he got your money?
You got an email notification as, he would have. He also would have got a notification that his item sold.
I can't see why you had to contact him at all, unless it was past the expected delivery time.

all i wanted was conformation email its not that hard...every other seller i have purchased from have managed to do it...because of the no contact i am beleiving he has just taken my money..it is just plain rude to ignore the person who sent money....its all good i will be getting my money back via paypal

You have left three negatives for sellers today. I hope one of them wasn't the seller you are talking about as it's very unfair.
Calculating your feedback percentage left the same way ebay calculates feedback sellers receive you are at 76%. To me, as a seller, that is a huge warning - I wouldn't buy from a seller with 76% and 42 transactions so it stands to reason it works the other way.
Sellers have a blocked bidder list for just this reason.

Oh my. You have completely ruined that poor sellers feedback for an item that isn't even overdue. That is shameful. This is a hobby seller who has used an ipad to post the auction. Quite possibly he didn't even realise you were sending emails - I have had a number of emails not make it to my personal inbox in the last week. This is the reason ebay shouldn't allow negatives to be allowed so readily by buyers who have unreasonable expectations

if i pay money for something stating that the product is in good condition as a consumer i have an expectation that the item will match the description

You haven't even received the item yet - nor have you allowed enough time to receive it. That negative is so premature it takes my breath away.

I really think that the part in the rules about communication, refers to pertinent communication. You communication was not pertinent to the sale. By your own admission, you knew he had got your payment.
I really don't understand why you had to have him email you in answer to a question that you already knew the answer to.

i checked my paypal today...so i only found out i couple of hours ago that he finalised payment on the 28th..so my email during the week is justified....like i said before its not hard to email me and just say yep i got your money and i will send it in a couple of days i wouldnt mind the wait at all if he contacted me...73 other sellers had the common courtesy to do it

I'm thinking that a lot of BBL lists just got a whole lot longer, eh?
Could somebody tell me if it is ok to contact a seller with whom I have never traded and suggest that they contact eBay and ask about the removal of grossly unfair feedback? (That FB was left on the 20th!!!!! 2 day sfter the sale!!!!!!) The item sold at 9:46pm on Wednesday Night! and the Feedback left at 11:11 AM Friday morning! Not even 2 full days!
OMG! I HAVE NEVER seen ANYTHING that mean!
Surely that has to be some sort of policy violation and any member who behaves in such a manner should at least be brought to the attention of eBay?

ive been ripped off like this in the past so forgive the negativity...it takes 2 minutes to send an email thats all i wanted the no contact makes me feel like its happening again
