I have been ripped off buying a pair of ray bans from seller *removed*. It has been 3 weeks since I bought them and nothing.
she has provided me with two false tracking numbers and because she has provided a tracking number saying an item was delivered to a suburb 20 mins away from me, eBay won't do anything about it.
i have been to the suburb post office it was delivered too and they said it was delivered to a home address.
The tracking number has no transit details just it has been delivered to a suburb that is not mine. eBay accept this as proof the seller sent me my parcel and tell me to take it up with the seller.
now looking at her recent feedback it appears they are false ray bans and she has now removed her other listings.
What can I do? I paid over $80.

Thank you, I have filed a PayPal claim now and will try your suggestion if that fails too. Really disappointed in EBay this is the first time I have had this happen which is lucky if eBay lets people like this sell on their site.

Maybe don't buy brand name items on eBay?
Buy real ones from real retailers. You're only going to get Raybans at a bargain price if they are stuffed used or fake.
And, from experience, they do not do any better job than a $20 servo pair of sunglasses.

I usually get my ray bans from my friend who works at sunglass hut, however I bought these thinking they were used ( as described) but your right never again, back to sunny hut. Just annoys me eBay lets her get away with it. However I'm not going to let her off so easy if I can help it!

Your negative should have dropped her rating to below standard, so once that other fake listing she's got up ends, she won't be able to list anything for awhile.
What I found interesting was, she seemed to have multiple identical used items. Also interesting that a few, including the ones you bought, had their listing removed after several relists. Removed by eBay, not the scammer.
I'm not even sure her current listing will stay up for long. It's a non tangible item, which is a no no on eBay. They'll soon catch up with her and end it.
If you can't claim not received due to the tracking saying delivered, throw a not as described at her. According to some sellers on the sellers forum found that when THEY asked ebay to step in and help, eBay immediately refunded the buyer and let them keep the item. If she wants to dispute the claim and asks eBay to step in, they should immediately rule in your favour without you having to return anything. Probably not good advice from me, but I loathe sellers who deliberately scam people.

A member was recently told by ebay that if an item was proved to have been delivered within 30ks of the buyer's address then they would accept that it had been successfully delivered. What a joke.
I would certainly make a fuss if I was told that....which is why I always fund my paypal payments with a Visa debit card.

I used a debit card through PayPal so does that mean I can get my refund easier?

If the seller refuses to refund, you can commence a chargeback with your bank if you used a Visa debit card. I'm not sure what the process is, but someone here will know. Don't leave it too long though as there is a time limit. Depends on which bank you're with as to what the time limit it.
