advise would be appreciated please
i bought a box set of dvd's
seller sent them with tracking but not sign on delivery the tracking say's it was delivered but i have not received it ,
it looks like it was just left at my door or even went to the wrong address
if it was left at my door anyone walking past could see it ,theres nowhere to hide it
ebay have knocked back my claim i have a claim in with ppal now but when i rang the girl said because it says delivered i will not get
my $73.50 back
i dont know what else if anything i can do to get my money back
i think the seller should have sent with signature required ( i do for anything $50 or over ) so i was silly and did not think to check that
they would send in the safest way possable so have i lost my $73 ??

i will wait to hear from ppal and take it further with them ( not the seller ) if they dont do the right thing

You are advising a member to commit a criminal offence - he would have most definitely been in the wrong if he was to listen to you!
And besides, PO most likely has his parcel.
And you think the buyer should be out of pocket for doing nothing wrong?
The buyer has buyer protection too you know.
If paypal has ruled in favour of the seller in the first instance and the buyer does a chargeback it is paypal that will pay the chargeback...they will not take it from the seller after releasing the money in the first place.
All you are doing is forcing paypal to honour both the seller and the buyer protection.

have you asked your postie if she had delivered and left a parcel somewhere for you? If she has, then some bypasser has taken it.
If she has not delivered a parcel, then I would enquire at the Mail-sorting Centre about it. Your Postmaster will give you the number of your local Mailsorting Centre.
Even there, they may not find it and I would launch a complaint to Australia Post.
Trouble is, that before Xmas they employ part time workers, and not all of them are honest people.
I learned this lesson a few years ago and now pay the extra couple of dollars to receive parcels with signature required.

im learning all the time i did not know that !!
so i could still do a charge back without it coming from the sellers pocket
i will still try ppal first but i may have to go that way if i dont get ppal to refund me
it's going to be hard work to get my money back i think

It seems that a few other posters here did not know the basics of paypal buyer and seller protection either.

That's not how it worked for me, with charge back paypal held my funds until it was resolved.
So this is all new to me, that's why i asked the question that you didn't answer, never mind.

If you have proof of postage to the buyer you have PP seller protection. You might have to argue, but you have it. If you are posting untracked or red box lodging, then you don't have the proof required to activate seller protection

Paypal will hold your funds until a chargeback is resolved. As soon as funds are subject to a dispute or chargeback they are put on hold.
If you won the original dispute and paypal released your funds they should also have released them the second time when the buyer initiated the chargeback.

once again - you are wrong!
Once and for all - please pay attention here:
Chargebacks have nothing to do with PP.
If both Ebay and PP decline the buyer's claim of non delivery - and seller has used tracking that is showing as "delivered" - buyer can indeed make a claim with his credit card issuer.
They in turn then contact PP to check on details, PP tells them parcel has been delivered.
They also reject the claim 99,9999 % of the time under those circumstances (according to the PP manager - the facts they have gathered over the years). But, if they do decide to believe the buyer and feel that he is a great customer of theirs (still talking about the credit card provider) they may refund him OUT OF THE BANK'S MONEY - NOT PP!
And finally - this chargeback action is most definitely NOT forcing PP to recognise and apply buyer protection - for the simple reason that buyer can't prove he didn't get it - and seller can prove that it was delivered.
Feel free to ring PP - preferably BEFORE you issue any more misleading advice.
